They were promoted as Superintendents of Central Excise/Superintendents of Customs (Group-B) and later as Assistant Commissioner of Customs and Central Excise (Group- A) in the year 2002. They were entitled for promotion as Deputy Commissioner during the year 2006 on completion of four years of service as Assistant Commissioner. As per Annexure A6 order dated 19.11.2010 they were granted promotion with effect from the date on which they have completed four years of service. The 11th applicant was promoted as Deputy Commissioner with effect from 1.10.2006 and all other applicants with effect from 10.12.2006. In the orders of promotion as Deputy Commissioner it is specifically stated that promotion is notional and on adhoc basis. They were promoted as Travelling Inspector of Accounts in the pay scale of Rs. 1640-2900/- in the year 1990. Having got two promotions they were not eligible for any financial upgradation under the ACP scheme of 1999 but with the introduction of MACP Scheme with effect from 1.9.2008 they were eligible for the 3rd financial upgradation but the same was denied on the ground that their posting as Stock Verifier was a promotion. The applicant retired from the service of the Employees' State Insurance Corporation (ESIC) on 31.12.2006 as Superintendent in the cadre of Insurance Inspector/ Manager Grade-II/Superintendent. The scale of pay of the cadre was Rs. 5500-9000 upto 20.04.2004. Subsequently, the pay scale was revised to Rs.6500-10500 notionally with effect from 21.04.2004 and with monetary benefits from 01.10.2007 vide Annexure A-1 letter dated 24.10.2007. (The UDCs have their financial upgradation under the ACP scheme and were enjoying the pay scale of Rs 5,500 - 9000). Their scale of pay prior to 01-01-2006 was Rs 5,500- 9,000/-.
