in the high court of jharkhand ranchi a. b. a. no. 3632 of 2012 sharawan kumar ... ... ... petitioner versus the state of jharkhand ... ... opp. party coram: the honble mr. justice prashant kumar ............ for the petitioner : mr. s.p. roy for the opp. party : mr. manoj kumar no.-4, a.p.p. ........ 3/10.01.2013 anticipatory bail application filed by petitioner sharawan kumar is moved by sri s.p. roy, learned counsel for the petitioner and opposed by sri manoj kumar no.-4, learned additional pp. for the state. f.i. r. reveals that informant, who is a police officer received confidential information that truck bearing registration no. up-65r 208.(owned by the petitioner) loaded with illicit coal will pass through maharo more. on the said confidential information, informant went to maharo more, but the said truck did not pass through aforesaid area. however, informant suspected that before he reach to maharo more, said truck would had already passed. there is no basis for coming to such conclusion. under the said circumstance, i allow this anticipatory bail application and direct the petitioner to surrender in the court below on or before 22nd of january 2013 and in the event of his surrender, the learned court below is directed to enlarge him on bail on furnishing bail bond of rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of shri d. kumar, learned judicial magistrate, 1st class, godda in connection with poraiyahat p.s. case no. 16 of 2007 corresponding to g.r. no. 77 of 2007, subject to the condition as laid down under section 438(2) of the cr. p.c.
