Bombay Habitual Offenders Act, 1959, (Maharashtra) Section 8

Title: Procedure by District Magistrates on Change of Residence of Habitual Offender to Other District

State: Maharashtra

.....other particulars of the registered offender, make a request to that District Magistrate that he may be informed of the steps, if any, which may have been taken in relation to the offender under any law for the time being in force in that other district; and upon the receipt of such information the District Magistrate of the first district shall cancel from his register the entry relating to that offender. (3) Upon the entry of the name and other particulars of a registered offender in any register in the State under sub-section (2), the provisions of this Act and the rules made thereunder shall apply to him as if he has been registered, in pursuance of a direction given under section 3, in the register of the district to which he has changed his ordinary residence.

.....as follows :- SECTION 01: SHORT TITLE This Act may be called the Maharashtra Construction of References to "District Magistrate" in the Hyderabad Area (Repeal) Act, 1960. SECTION 02: REPEAL OF CERTAIN PROVISIONS RELATING 10 COLLECTORS AND ADDITIONAL DISTRICT MAGISTRATES IN HYDERABAD AREA (1) Any provision of a law which, in effect, provides that references to the District Magistrate in relation to the Hyderabad area or any district therein mean, or shall be construed as references to, "the Collector" or "Collector and Additional District Magistrate" shall be deemed to have ceased to have effect from the first day of September 1959, except as respects things done or omitted to be done before that date. (2) The enactments in the Schedule shall be deemed to have been deleted on the aforesaid date. SCHEDULE 1 SCHEDULE (See section 2) 1. Clause (4-A) of section 3 of the Prisons Act, 1894 (IX of 1894), in its application to the State of Maharashtra. 2. Clause (5-A) of section 2 of the Bombay Police Act, 1951 (Bom. XXII of 1951). 3. Title: Magistrates and Medical Officers Who May Exercise the Powers of the Controller

(1) Subject to the provisions of sub-section (3) of section 10, any District Magistrate in Assam may exercise in respect of his exercise district any power which the Controller by or under this Act could exercise in such district. (2) The Controller may transfer any proceeding under Chapter II pending before him to the District Magistrate having jurisdiction under sub-section (1) to dispose of it. (3) {Substituted by the A.O. 1937 for "The L.G. of a recruiting province may invest a District Magistrate or a Sub-divisional Magistrate and the L.G. of Assam may invest a Sub-divisional Magistrate".} [The Central Government may invest a District Magistrate or a Sub-divisional Magistrate in any recruiting State and a Sub-divisional Magistrate in Assam] with any of the powers of the Controller under section 4 or section 33 or section 34 or section 35 in respect of his district or sub-division, as the case may be. (4) The {Substituted, A.O. 1937, for "L.G."} [Central Government] may invest any medical officer not below the rank of Assistant Surgeon with any of the powers of the Controller under section 33 and section 35.

Title: Powers of Collector or District Magistrate to Prevent Offences Relating to Sati

.....to preserve the memory of any person is respect of whom sati has been committed, by order, direct the removal of such temple or other structure. (3) Where any order under sub-section (1) or sub-section (2) is not complied with, the State Government or the Collector or the District Magistrate, as the case may be, shall cause the temple or other structure to be removed through a police officer not below the rank of a Sub-Inspector at the cost of the defaulter. Section 8 - Power to seize certain properties (1) Where the Collector or the District Magistrate has reason to believe that any funds or property have been collected or acquired for the purpose of glorification of the commission of any sati or which may be found under circumstances which create suspicion of the commission of any offence under this Act, he may seize such funds or property. (2) Every Collector or District Magistrate acting under sub-section (1) shall report the seizure to the Special Court, if any, constituted to try any offence in relation to which such funds or property were collected or acquired and shall await the orders of such Special Court as to the disposal of the same.

Title: Chief Metropolitan Magistrate and District Magistrate to Assist Recovery Officer in Taking Charge of Property

(1) Where any property is sold or leased in pursuance of any power conferred by section 36E, the recovery officer may, for the purpose of taking into custody or under control any such property, request, in writing, the Chief Metropolitan Magistrate or the District Magistrate within whose jurisdiction any such property or other documents relating thereto may be situated or found to take possession thereof, and the Chief Metropolitan Magistrate or as the case may be, the District Magistrate shall, on such request being made to him,-- (a) take possession of such property and documents relating thereto; and (b) forward them to the recovery officer. (2) For the purpose of securing compliance with the provisions of sub-section (/), the Chief Metropolitan Magistrate or the District Magistrate may take or cause to be taken such steps and use, or cause to be used, such force, as may, in his opinion, be necessary. (3) No act of the Chief Metropolitan Magistrate or the District Magistrate done in pursuance of this section shall be called in question in any court or before any authority.
