Interested witness

Interested witness, a close relative who is a natural witness cannot be regarded as an interested witness. The term 'interested' postulates that the witness must have some direct interest in having the accused somehow or the other convicted for some animus or for some other reason, Kartik Malhar v. State of Bihar, (1996) 1 SCC 614 (620).A witness is not excluded from giving evidence by reason of his interest in the matter in question, 6 & 7 Vict. c. 85, s. 1.Means a close relative who is a very natural witness cannot be termed as an interested witness. the time it takes for one half of a substance decaying in a first order reaction to be destroyed For radioactive substances it is the time required for one half of the initial amount of the radioactive isotope to decay The half lifeis a measure of the rate of the reaction being observed For processes that are true first order processes such as radioactive decay the half life is independent of the quantity of material present and it is thus a constant The time it takes for one half the remaining quantity of a radioactive isotope to decay will be the same regardless of how far the decay process has advanced Some chemical reactions are also first order and may be characterized as having a half life However for chemical reactions the half life will depend upon temperature and in some cases other environmental conditions whereas for radioactive isotopes the rate of decay is largely independent of the environment...


Material witness

Material witness, the test whether a witness is material for the present purpose is not whether he would have given evidence in support of the defence. The test is whether he is a witness 'essential to the unfolding of the narrative on which the pros. is based.' Whether a witness is so essential or not would depend on whether he could speak to any part of the prosecution case or whether the evidence led disclosed that he was so situated that he would have been able to give evidence of the facts on which the prosecution relied. Related witness and interested witness, 'related' is not equivalent to 'interested'. A witness may be called 'interested' only when he or she derives some benefit from the result of a litigation; in the decree in a civil case, or in seeing an accused person punished.
