25. 01-2012 Petitioner being husband is apprehending his arrest in a complaint case in which cognizance has been taken under Section 498A of the I.P.C. The marriage was performed in 1998 and out of the wedlock there is a female child also. Learned counsel for the complainant, on instruction submits that reconciliation is not possible, though suggestion was given before learned Court below with regard to payment of maintenance, but it was not accepted by the petitioner. Petitioner is ready to pay Rs. 2000/- from March, 2012 by depositing the same in the account of the complainant by second week of every month. Let the petitioner serve a copy of this order to the complainant when the complainant will supply the account number within a period of two weeks. The aforesaid payment will be subject to any order being passed in matrimonial or maintenance proceeding. Considering the aforesaid facts, let the petitioner namely Brijesh Giri, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail, on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Complaint Case No. 2574 of 2010, Trial No. 3449 of 2011. Three consecutive defaults in payment will give liberty to the complainant to file appropriate application for cancellation of bail of the petitioner. (Dinesh Kumar Singh, J.) Shageer/-
