22. 06/2012. PRESENT HON'BLE MR. JUSTICE SANGEET LODHA, V.J.

Mr. D.N. Yadav, for the petitioner. Mr. Ashok Prajapat, PP for the State. -- 1. Heard learned counsel for the applicant and the learned Public Prosecutor and also perused the material available on record.

2. An FIR/CR (46/2012) has been registered inter-alia against the applicants herein for commission of offences under Sections 498-A, 323 and 324 of IPC at Police Station- Mahila Thana, Pali.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. The applicant and the complainant contacted 'Nata' marriage and at the time of said marriage, no dowry articles were taken. The applicant is behind the bars for last 7-8 days and, therefore, on the facts and in the circumstances of the case, the applicant may be enlarged on bail.

4. Learned Public Prosecutor opposed the bail application.

5. Having regard to the nature of accusation and taking into consideration totality of the facts and circumstances of the case, 2 of 2 without expressing any opinion on the merits of the case, I deem it just and proper to enlarge the accused applicant on bail.
