2. Accordingly,I.A.No.1226of2013isdisposedofaswithdrawn.

3. Thisappealhasbeenadmittedvideorderdated9th July,2012.Records andproceedingsofSessionsTrialNo.355of2008/99of2009wascalledfor fromthetrialcourtsoastoreachtothisCourtforappreciatingtheargument forsuspensionofsentence.

4. RecordsandproceedingsofSessionsTrialhasbeenreceivedbythisCourt andwehave perusedthe same andheardthe learnedcounsel for boththe sides.

5. Lookingtotheevidencesonrecord,itappearsthatthepresentappellants are original accused nos. 1 and 5 in the Sessions Trial. They have been punishedmainlyfortheoffencepunishableunderSection302oftheIndian 2 PenalCodeforlifeimprisonment.

Looking to the evidences on record, there is prima facie case against theseappellants.Asthecriminalappealispending,wearenotmuchanalyzing theevidencesonrecord,but,sufficeittosaythatthecaseoftheprosecutionis baseduponthedepositionsoftheseveraleyewitnesseswhoareP.W.1,P.W.4, P.W.5andP.W.7.P.W.7isaninformant.Lookingtothedepositionsoftheseeye witnesses,theyhaveclearlynarratedtheroleplayedbythesetwoappellants. The appellants have caused injury upon the deceased by sharp cutting instrument as well as by lathi which has resulted into the death of the deceased.Thedepositionoftheeyewitnessesisconstitutingaprimafaciecase againsttheseappellants.Moreover,depositionoftheseeyewitnessesisgetting enoughcorroborationbythedepositiongivenbyDr.AnitaSundi(P.W.9Court WitnessNo.1).Lookingtotheseevidencesonrecord,thereisprimafaciecase and,therefore,lookingtothegravityofoffence,quantumofpunishmentand the manner in which these two appellants are involved in the offences as alleged by the prosecution and looking to the prima facie case, we are not inclinedtosuspendthesentenceawardedtothembythetrialcourt.Thereis nosubstanceintheprayerforsuspensionofsentenceand,hence,thesameis, hereby,rejected.
