Full Judgment
The writ petitioner has given his choice for mechanical or electrical engineering course and also has indicated 10 Institutes where he can be admitted to, as such admission is done on the basis of ranking of individual candidates. The writ petitioners name was recommended for Elite Institute of Engineering and Management, Ghola, Kolkata in Automobile engineering course. This is a private institute and the petitioner is reluctant to get admitted because of high fees the said Institute is alleged to be charging. According to the petitioner, the Institute charges more than 10 times of fees vis--vis a similar institute run by the State Government.
Learned counsel appearing for the respondent No.5 submits that the Institute has been allotted to him on the basis of his ranking and gradation as per the options given by the petitioner. His further submission is counselling for such admission is already over. In these circumstances I choose to dispose of the writ petition without calling for any affidavit by directing the respondent No.5 to examine the question as to whether there is any existing vacancy in any of the technical institutes in mechanical and electrical engineering stream and if such vacancy occurs in any of the Institutes and on the basis of his ranking the petitioner can be accommodated in such an institute, then the petitioner may be accommodated in such Institute.
With such directions the writ petition is disposed of. As this writ petition is being disposed of without calling for any affidavits, the allegations made in the writ petition shall be deemed to have not been admitted. Photostat certified copy of this order be made available to the parties upon compliance of usual formalities.
