ORDER
The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 126(2), 296(b), 115(2), 118(1) and 351(3) of BNS, in Crime No.12 of 2026, seeks anticipatory bail.
2. The allegation against the petitioner is that the petitioner demanded
money from the complainant to purchase liquor. When the complainant did not give money, the petitioner attacked him with a broken bottle, causing injuries. Hence, the case has been registered.
3. The learned counsel for the petitioner would submit that the petitioner
is ranked as A1 in this case and was also injured in the alleged occurrence. He further submitted that the petitioner is also taking treatment and he is ready to cooperate with the investigation. Therefore, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.side) appearing for the
respondent police reiterated the prosecution case and submitted that the petitioner is a habitual offender and is already involved in six previous cases, out of which four cases are under 307 IPC. Hence, he opposed the grant of anticipatory bail to the petitioner.
5. Considering the fact that the petitioner is a habitual offender and in this case
he attacked the de facto complainant with the broken bottle, if released on bail, he may indulge in similar offences, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. Mpa Index:Yes/No
