HON'BLE DR. JUSTICE SWARANA KANTA SHARMA
ORDER
% 01.04.2026
1. By way of the present writ petition, the petitioners are seeking
quashing of FIR bearing no. 155/2017, registered at Police Station Economic Offences Wing (EOW), Delhi, for the commission of offence punishable under Sections 420/467/468/471/511/120B of Indian Penal Code, 1860 (hereafter ‘IPC’).
2. Issue notice. The learned APP accepts notice on behalf of the State.
3. All the petitioners and the Authorised Representative (AR) of
respondent no. 2 (through VC) are present before this Court and have been identified by their counsels and concerned Investigating Officer (IO) from Police Station EOW, Delhi.
4. Briefly stated, facts of the present case are that on the complaint of
respondent no. 2/Company, the FIR in this case was registered on 20.09.2017. On 13.03.2020, the respondent no.2/company had filed civil suit against the petitioners. On 07.04.2022, the chargesheet in this case was filed against the petitioners.
5. It is stated that both the parties have amicably settled the present matter vide Order of Compromised Decree dated 13.03.2020.
6. On a query made by this Court, AR respondent no.2 who has been
identified by the concerned IO, has categorically stated that the matter has been settled between the parties and he has no objection if the present FIR is quashed.
7. In view of the above fact that the parties have amicably resolved their
differences out of their own free will, without any coercion and no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.
8. Accordingly, FIR bearing no. 155/2017, registered at Police Station EOW, Delhi, for the commission of offence punishable under Sections emanating therefrom are quashed.
9. In view of the above, the present writ petition stands disposed of.
10. The order be uploaded on the website forthwith. DR. SWARANA KANTA SHARMA, J APRIL 01, 2026/zp/r
