.....order dated 08.08.2025 passed in review petition no. 13/2025 in the said lpa, the following directions were required to be complied with: “4. accordingly, para 24 of the judgment dated 4 september 2024 shall read thus:“24. thus, in the peculiar facts of the present case, this court directs the appellant to treat the respondent reinstated in service from the date he was terminated from service i.e. 20.07.1993 and his pay, allowances and seniority be fixed as per his eligibility and he be paid 50% wages as due to him. this court also directs the appellant to pay respondent rs.2.5 lacs towards litigation expenses and compensation. the appellant is directed to comply with the directions of this court within four weeks.”7. an amount of rs.2,50,000/- towards litigation and compensation was deposited by the respondents in the registry of this court, pursuant to the directions contained in the order dated 05.05.2025 passed in these proceedings.8. vide order dated 23.07.2025, the petitioner was permitted to withdraw an amount of rs.50,000/- out of the said amount. the petitioner is now permitted to withdraw the remaining amount as well including the accrued interest.9. let the same be released by the registry of this court to the petitioner as expeditiously as possible.10. further, the learned counsel for the respondents submits, oninstructions, that the entitlement of the petitioner towards pay allowances, seniority etc. shall be worked out and the dues shall be paid latest within a period of eight (8) weeks from today.11. taking on record the aforesaid undertaking of the learned counsel for the respondent, the present petition stands disposed of.12. it is made clear that if the said dues of the petitioner are not fully paid within a period of eight (8) weeks from today as undertaken, the same shall be construed as an egregious breach on the part of the respondent, of the orders passed by this court.13. the date already fixed i.e. 09.07.2026, stands cancelled......

1. Allowed, subject to all just exceptions.

2. Application stands disposed of. CM APPL.23036/2026 (early hearing)

3. This is an application seeking early hearing of the present petition.

4. Considering the averments made in the application, the same is allowed.

5. CONT.CAS(C) 1389/2024, is taken up for hearing today itself. CONT.CAS(C) 1389/2024

6. Concededly, in terms of the order dated 04.09.2024 passed in the LPA

No. 889/2024 read with order dated 08.08.2025 passed in Review Petition no. 13/2025 in the said LPA, the following directions were required to be complied with: “4. Accordingly, para 24 of the judgment dated 4 September 2024 shall read thus:

“24. Thus, in the peculiar facts of the present case, this Court directs the appellant to treat the respondent reinstated in service from the date he was terminated from service i.e. 20.07.1993 and his pay, allowances and seniority be fixed as per his eligibility and he be paid 50% wages as due to him. This Court also directs the appellant to pay respondent Rs.2.5 lacs towards litigation expenses and compensation. The appellant is directed to comply with the directions of this Court within four weeks.”

7. An amount of Rs.2,50,000/- towards litigation and compensation was deposited by the respondents in the Registry of this Court, pursuant to the directions contained in the order dated 05.05.2025 passed in these proceedings.

8. Vide order dated 23.07.2025, the petitioner was permitted to withdraw an amount of Rs.50,000/- out of the said amount. The petitioner is now permitted to withdraw the remaining amount as well including the accrued interest.

9. Let the same be released by the Registry of this Court to the petitioner as expeditiously as possible.

10. Further, the learned counsel for the respondents submits, on

instructions, that the entitlement of the petitioner towards pay allowances, seniority etc. shall be worked out and the dues shall be paid latest within a period of eight (8) weeks from today.

11. Taking on record the aforesaid undertaking of the learned counsel for the respondent, the present petition stands disposed of.

12. It is made clear that if the said dues of the petitioner are not fully paid within a period of eight (8) weeks from today as undertaken, the same shall be construed as an egregious breach on the part of the respondent, of the orders passed by this Court.
