2. Learned Counsel for the petitioner submits that the present petition has

become infructuous as the suit has been disposed of vide judgment dated 30th January, 2026. It is prayed that the present petition be disposed of as withdrawn with liberty to raise all his rights and contentions in case any appeal is filed by the petitioners.
