3. This is an Application filed by the Petitioner under Section 483 of the

Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of Interim Bail in Case No. VIII/01/DZU/2024 under Sections 21 / 23 / 25 / 27 / 28 / 29 / 30 of the Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Narcotics Control Bureau-Delhi Zonal Unit, for a period of twelve weeks, on medical grounds.

4. The learned Senior Counsel for the Petitioner submitted that the Petitioner is suffering from multiple serious ailments coupled with co- BAIL APPLN. 2231/2026 Page 1 of 4

morbidities, which has constantly affected the Petitioner while being in custody. The medical ailments, inter alia, include chronic liver disease, spinal decompression and lower back Radiculopathy, Hypertension, Type-II Diabetes, severe lower back issues coupled with seizure disorder and Parkinson disease.

5. In the past, the Petitioner was granted Interim Bail on various

occasions on medical grounds. Vide order dated 21.01.2026 passed in Bail Appl. No. 5020/2025, this Court granted Interim Bail for a period of thirty days to the Petitioner on medical grounds while noting that the Petitioner had been suffering from multiple ailments.

6. The Petitioner having persisting ailments required further medical

supervision and applied for extension of Interim Bail by filing the Bail Appl. No. 1072/2026. This Court allowed the said application vide order dated 24.03.2026 by granting an extension of Interim Bail for further period of eight weeks.

7. The Petitioner further filed for extension of Interim Bail on medical

grounds in Bail Appl. No. 1923/2026, in which vide order dated 18.05.2026, an extension of Interim Bail was granted till the next date the said application was disposed of vide order dated 03.06.2026 by extending the period of Interim Bail for further two weeks, which is expiring on 17.06.2026.

8. It was submitted by the learned Senior Counsel for the Petitioner that

in light of serious medical conditions, the Petitioner was reviewed at PGI Chandigarh on 04.05.2026 and was provisionally diagnosed with Cirrhosis. Thereafter, he was referred to medical Oncology for Malignant Melanoma. On 05.05.2026, the Petitioner was advised to undergo Endoscopy and an BAIL APPLN. 2231/2026 Page 2 of 4 appointment for the same was scheduled on 21.05.2026. Further, he was advised to undergo a fresh MRI for his lower spine. For further evaluation of his Malignant Melanoma, the Petitioner had been advised to undergo a PET CT scan, which is to ascertain the spread of Melanoma.

9. It was further submitted by the learned Senior Counsel for the

Petitioner that on 07.05.2026, the condition of the Petitioner deteriorated, and he was admitted to the Hospital and was later discharged after undergoing Chemotherapy and the Petitioner is due for Chemotherapy session on 23.06.2026 and is also under treatment for liver Cirrhosis and PIVD lumber spine for which the surgery has already been suggested by the Doctors.

10. Issue Notice. The learned SSC accepted the Notice and sought time to verify the medical records.

11. However, considering the submissions made on behalf of the Petitioner and a perusal of the latest medical documents, it is found that the Petitioner is suffering from serious medical ailments like Malignant Melanoma.

12. In view of the above and the fact that the Interim Bail granted earlier

is expiring on 17.06.2026 and the Chemotherapy session is scheduled on 23.06.2026, the present Application is allowed on the medical grounds and the Interim Bail granted to the Petitioner is extended for further period of four weeks from 17.06.2026 on the same terms and conditions as contained in the order dated 21.01.2026 passed in Bail Appl. No. 5020/2025.
