3. By way of the present petition, the petitioners seek quashing of the
FIR bearing No. 406/2023, registered at Police Station Budh Vihar, Delhi, for the commission of offences punishable under Sections ‘IPC') and all consequential proceedings emanating therefrom on the basis of settlement arrived at between the parties.
4. Issue notice. The learned APP accepts notice on behalf of the State.
5. All the petitioners and respondent no. 2 to 5 are present before this Court and have been identified by their counsel and Investigating Officer
(IO) concerned, Police Station, Budh Vihar, Delhi.
6. Brief facts of the case are that the petitioners and respondent nos. 2 to
5 are neighbours in relation and due to some parking issue, various differences and disputes had arisen between the petitioners and the respondent nos. 2 to 5 wherein the respondent nos. 2 to 5 had suffered some injuries. Upon the complaint by respondent nos. 2 to 5, the present FIR came to be registered against the petitioners. It is also stated that a cross-FIR bearing no. 409/2023 was also registered in the same Police Station by respondent nos. 2 to 5 against the petitioners. It is stated that with intervention of the family and friends, the parties have now amicably settled their dispute vide Memorandum of Understanding (MoU) dated 14.05.2026.
7. On a query made by this Court, respondent nos. 2 to 5 who have been
identified by the IO, have categorically stated that they have entered into compromise out of their own free will and without any pressure, coercion or threat. Therefore, they have no objection if the present FIR is quashed.
8. In view of the above, that the parties have amicably resolved their
differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.
9. Accordingly, FIR bearing No. 406/2023, registered at Police Station Budh Vihar, Delhi, for the commission of offences punishable under
Sections 308/323/452/34/354/509/325 of IPC and all consequential proceedings emanating therefrom are quashed, subject to the petitioner nos. 1 and 2 depositing a sum of Rs. 5,000/- each with the Delhi High Court Advocates Welfare Trust, Current A/C No. 15530210002995, UCO Bank, Delhi High Court, IFSC UCBA0001553, and petitioner nos. 3 and 4 depositing a sum of Rs. 5,000/- each with the Civil and Sessions Courts Stenographers’ Association, Delhi within a period of 2 weeks and compliance report of the same be filed with the Registry of this Court, within a period of one week thereafter.
10. Accordingly, the petition stands disposed of.
