1. Heard learned counsel for the petitioner and JC to SC 6.

2. This writ application has been filed for issuance of a direction upon the respondents to publish the second list of selected candidates for appointment oh the post of police constable pursuant to advertisement No. 1 of 1998.

3. It is submitted by learned counsel for the petitioner that second list of selected candidates has not been published even despite directions, issued by the Deputy Inspector General of Police, Magadh Range, Gaya, dated 11th October, 2000.

4. JC to SC 6, however, submits that the committee is required to be reconstituted and some of the Superintendents of Police have been transferred.

5. It appears that this Court vide order dated 12.11.2001 while granting four weeks time to the State counsel to take instruction observed :--

'Pendency of this case will not prevent the concerned authority from publishing the second list of the successful candidates for appointment to the post of police constable.'

6. It appears that even after four years, second list of successful candidates has not been published. Non-publication of the second list of successful candidates may be for the reason of transfer of some of the Superintendents of Police of Gaya Division, but, in any view of the matter, the Director General of Police, Government of Bihar, could have constituted a committee in accordance with law for this purpose.

7. Considering the facts and circumstances of the case, the Director General of Police, Government of Bihar, is directed to reconstitute the committee for the purpose of publication of the second list of successful candidates for the posts of police constable pursuant to advertisement No. 1 of 1998. This exercise, however, must be completed by the Director General of Police, Government of Bihar, within a period of six weeks from the date of receipt/production of a copy of this order.

8. In case, the committee is reconstituted within the aforesaid period, second list of successful candidates shall be published by the committee in accordance with law within a further period of four weeks from the date of constitution of the committee.

9. With the direction/observation aforesaid, this application is disposed of.
