Full Judgment
(Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents 1 and 2 to reactivate the electricity service connection number 246 in the petitioner's agriculture land in S.No.40-A/2 situated in Silatur Aranthangi Taluk, Pudukkottai District, within the time stipulated by this Court by considering the petitioner's representation dated 09.05.2015.)
1. The petitioner seeks for a Mandamus directing the respondents to reactivate the electricity service connection number 246 in the petitioner's agriculture land in S.No.40-A/2 situated in Silatur Aranthangi Taluk, Pudukkottai District, within the time stipulated by this Court, by considering the petitioner's representation dated 09.05.2015.
2. The grievance of the petitioner is that even though such representation is made, the same has not been considered sofar. Hence, he has come forward with the present Writ Petition for the relief stated supra.
3. On the other hand, it is the contention of the learned Standing Counsel appearing for the respondents that such service connection stands in the name of four persons and therefore, the respondent is not in a position to consider the claim of the petitioner.
4. Whatever may be the case, if a request is made, it is for the respondents to consider and pass appropriate orders on the same, on merits and in accordance with law, so that if an adverse order is passed against her, the petitioner will be in a position to challenge the same before the appropriate forum.
5. Therefore, without expressing any view on the claim made by the petitioner, I only direct the respondents to consider the representation of the petitioner, dated 09.05.2015 and pass appropriate orders, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
With the above direction, this writ petition is disposed of. No costs.
