The writ petition has been filed praying this Court for issuance of a writ of Mandamus directing the respondents herein to grant permission to conduct the ".Aadalum Paadalum". dance programme on 28.06.2014 and 29.06.2014 from 8.00 p.m. to 12.00 p.m., in pursuant to the ".Aani Festival". of the ".Melamanakadu Arulmigu Mangala Vinayagar Kovil situate at Melamanakadu Village, Peravurani Taluk Thanjavur District by considering the petitioner's representation dated 21.06.2014.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.

In the affidavit, it has been stated that the petitioner is the President of the Temple Festival Committee of Melamanakadu Arulmigu Mangala Vinayagar Kovil and in the said village, there is a temple called as Melamanakadu Arulmigu Mangala Vinayagar Kovil. Every year, in the said temple, festival is conducted. This year also, Aani Festival is being conducted for about 2 weeks and Mandagapadi is scheduled to be held on 28.06.2014 and 29.06.2014 and to celebrate the same, they were proposed to conduct cultural activities, traditional songs and Aadalum Paadalum programme on 28.06.2014 and 29.06.2014. But the respondents refused to give permission to conduct the dance progrmme. Hence, they sent a detailed representation dated 21.06.2014 to the respondents. Since the said representation has not been considered till date, the Petitioner has come forward with the present Writ Petition.

Today, when the matter is taken up for hearing, the learned Additional Government Pleader submitted that permission was already granted to conduct the cultural activity namely 'Aadal Paadal', but only the use of loud speakers is prevented. He would further submit that instead of loud speakers, the petitioner may be permitted to use box speakers without decibel sound. He also submitted that on an earlier occasion, this Court by accepting the submission of the learned Government Advocate, imposed 23 conditions to conduct Adal Padal programme and if the same conditions are imposed the respondents will consider the application of the petitioner. The conditions imposed by this Court on an earlier writ petition are as follows:

5. The learned counsel appearing on behalf of the petitioner submits that he would abide by all the above said 23 conditions, which are enumerated by the respondent Police.

In view of the submission made by the learned Additional Government Pleader, this Court directs the respondents to grant permission to celebrate the festival of ".Melamanakadu Arulmigu Mangala Vinayagar Kovil". situated at Melamankadu Village, Peravurani Taluk, Thanjavur District along with cultural activity namely 'Aadal Paadal' on 28.06.2014 and 29.06.2014 by using box speakers with low decibel sound and by imposing the above said conditions. Further, this Court directs the respondent police to pass necessary orders incorporating the conditions as enumerated above. The writ petition is disposed of with the above directions. No costs.
