.....mr.vishal sharma, for the petitioner. mr.s.k.vyas, government advocate ..by the court : issue notice. learned government advocate under the instructions of court accepts the same. looking to the narrow amplitude of controvers.involved in this petition for writ, the petition is heard finally and is disposed of by this order. in brief, facts of the case are that shri pukhraj (husband of the petitioner) is serving life term imprisonment being convicted for offence punishable under section 302 i.p.c.inter alia by the learned special judge, sc/st (prevention of atrocities) act cases, merta city by the judgment dated 27.8.2003 in sessions case no.52/2003 (old no.20/99).the appeal preferred by the convict prisoner before division bench of this court, being d.b.[2].criminal appeal no.1089/2003 has also been rejected on 29.7.2005. hon`ble the apex court also refused to grant special leave to appeal by the judgment dated 25.9.2006. as per averments contained in the petition, the conduct of convict prisoner is quite satisfactory and he has also completed imprisonment for an actual term of more than 14 years.it is stated that the convict prisoner is eligible to be considered for permanent parole but his case has yet not been taken up for consideration by the state level parole committee. it is further submitted that case of a co-accused mohan lal has also been considered and he has already been released on permanent parole. looking to the facts of the case, we deem it appropriate to dispose of this petition for writ by directing the respondents to consider case of the convict prisoner for grant of permanent parole if he is otherwise eligible for the same as per provisions of the rajasthan prisoners release on parole rules, 1958 expeditiously as far as possible on or before 01.9.2014. the petition for writ stands disposed of accordingly. In brief, facts of the case are that Shri Pukhraj (husband of the petitioner) is serving life term imprisonment being convicted for offence punishable under Section 302 I.P.C.inter alia by the learned Special Judge, SC/ST (Prevention of Atrocities) Act Cases, Merta City by the judgment dated 27.8.2003 in Sessions Case No.52/2003 (Old No.20/99).The appeal preferred by the convict prisoner before Division Bench of this Court, being D.B.[2].Criminal Appeal No.1089/2003 has also been rejected on 29.7.2005.
