JUSTICE SHRI. K.R. UDAYABHANU:PRESIDENT

Appellant is the opposite party in CC.52/09 in the file of CDRF, Kollam. The appellant is under orders to pay a sum of Rs.3,13,815/- with interest at 12% and also to pay compensation of Rs.20,000/- and cost of Rs.1,500/-.

The matter relates to the alleged defective construction by the appellant as contractor. The appellant/opposite party was exparte before the Forum. In the circumstances and in view of the fact that the matter has been disposed of uncontested the order of the Forum is set aside on condition that the appellant pay a sum of Rs.10,000/- to the complainant or deposit the same before the Forum which can be withdrawn by the complainant.
