It is further submitted that petitioner has been falsely implicated in this case as admitted there is some landlord and tenant dispute. So, petitioner deserves the privilege of anticipatory bail. Learned APP has opposed the prayer for anticipatory bail. Be that as it may, I am inclined to admit the petitioner on anticipatory bail. No. 795 of 2014, registered under Sections 419, 420, 467, 468 and 471 of the I.P.C., lodged on the basis of one written report given by Krishna Kumar Sao, Executive Engineer, National Highway Division, Hazaribagh alleging that in the aforesaid Division an agreement arrived between petitioner and National Highway for extension of NH-100 from km 0.00 to 21.00 and from 62.65 to 73.00 and petitioner has furnished a bank guarantee of Rs. 48,64,000.00 issued by Bank of India, Pithoria Branch. Subsequently, it was found that the aforesaid bank guarantee was forged. Learned counsel for the petitioner referred to letter dated 18.01.2011 issued by Branch Manager, whereby he has confirmed that the bank guarantee of Rs. 48,64,000/- has been issued in favour of Executive Engineer, National Highway, Hazaribagh. Subsequently, it transpired that the same bank in 2014 had denied to have issued the bank guarantee. It appears that this casts suspicion in the entire prosecution case and period of bank guarantee was valid up to 21.01.2014, which has already expired and F.I.R. has been lodged on 07.03.2014. So, petitioner deserves the privilege of of anticipatory bail. Learned APP, on the other hand, opposed the prayer for anticipatory bail and relied on the letter of the bank at paragraph-59 & 60 of the case diary, whereby Branch Manager of the Bank of India has supported the case of prosecution. Be that as it may, in view of the submissions of learned counsel for the petitioner and the contradictory -4- stand of the prosecution itself and also the fact that period of bank guarantee has lapsed and the matter is pending before Arbitrator, I am inclined to admit the petitioner on anticipatory bail.
