The prayer herein is for quashing Annexure-A final report in Crime No.34/2002 of Kattoor Police Station pending as S.T.No.4379/2006 on the file of the Judicial First Class Magistrate Court, Irinjalakuda.
2. This Court by an interim order dated 14/01/2013 directed the petitioner to surrender before the court below within a period of one week in the light of the settlement between the parties and that bail will be granted to the petitioner on suitable conditions to be fixed by the court below.
3. It is the statement of the learned counsel for the petitioner that the petitioner had to go abroad in the meanwhile and, therefore, he is unable to comply with the interim order. It is also prayed that he may be allowed to withdraw the criminal miscellaneous case with liberty to move again. The criminal miscellaneous case is accordingly dismissed as withdrawn. Sd/- (T.R.
