West Bengal Medical Council (Temporary Supersession) Act, 1985 Complete Act

.....the West Bengal Medical Council constituted under the Act; (d) other words and expressions have the meanings respectively assigned to them in the Act. Section 3 Supersession of the Council (1) With effect from the date of coming into force of this Act, and for a period of two years from such date, the Council shall stand superseded. (2) The State Government may, if it considers necessary so to do, by notification published in the Official Gazette, extend from time to time the period of supersession referred to in sub-section (1) by any period not exceeding six months at a time, so, however, that the aggregate period of supersession under this section shall not exceed three years. 11. Sub-sec. (3) ins. by W.B. Act 34 of 1989. (3) Notwithstanding the provisions of section 9, the period of supersession of the Council shall be held to include any period which may elapse between the expiry of the said period of supersession and the date of reconstitution of the ad hoc Council under sub-section (1) of section 5A. .....as the State Government may, by notification in the Official Gazette, appoint and different dates may be appointed for different provisions of this Act. Section 2 Definitions In this Act, unless there is anything repugnant in the subject or context, (1) "goods" includes all kinds of movable property other than actionable claims, stock, shares or securities or personal luggage of passengers travelling in the vehicle when such luggage is not charged for or the equipments used in such vehicle; (2) "goods vehicle" means any motor vehicle, constructed or adapted for use for the carriage of goods, or any motor vehicle not so constructed or adapted but used for the carriage of goods solely or in addition to passengers and includes a trailer when attached to such vehicle; (3) "month" means any month reckoned according to the English Calender; (4) "notification" means a notification published in the Official Gazette; (5) "operator" means the owner or any person having possession or control of a goods vehicle or a stage carriage and includes any person whose name is entered in the permit granted under the Motor Vehicles Act, 1939, as the holder thereof; (6) "passenger" means any.....

.....Application of the Act The Motor Vehicles Act, 1939 (hereinafter referred to as the principal Act), shall, in its application to West Bengal, be amended for the purposes and in the manner hereinafter provided. Section 3 Amendment of section 45 of Act 4 of 1939 In section 45 of the principal Act, in sub-section (1), after the words "Every application for a permit", the following words shall be inserted : "shall be accompanied by a receipt of profession tax paid by the owner of the vehicle or vehicles under any law for the time being in force and". Section 4 Amendment of section 58 In section 58 of the principal Act, in sub-section (2), after the second proviso, the following proviso shall be added: "Provided also that every application for renewal of a permit shall be accompanied by a receipt of profession tax paid by the owner of the vehicle or under any law for the time being in force." WHEREAS Elvoc Private Limited had been engaged in the manufacture of precision electrical and electronic products comprising battery chargers, transformers, battery eliminators, voltage stabilizers and rectifiers; AND WHEREAS an order has been made for the winding up of the Company and proceedings for its liquidation are pending in the High Court at Calcutta; AND WHEREAS for the purpose of utilising the production facilities and equipment of the undertakings of the Company with a view to increasing the production of precision electrical and electronic goods and generating employment in the interest of the general public, it is necessary to acquire the undertakings of the Company; It is hereby enacted as follows: Section 1 Short title and commencement (1) This Act may be called the Elvoc Private Limited (Acquisition and Transfer of Undertakings) Act, 1985. (2) It shall be deemed to have come into force on the 5th day of August, 1985. (2) It shall be deemed to have come into force on the 8th day of July, 1985. Section 2 Definitions In this Act, unless the context otherwise requires, (a) "appointed day" means the date on which this Act comes into force; (b) "Commissioner" means the Commissioner of Payments appointed under section 7; (c).....

Calcutta University Institute (Taking over of Management of Auditorium) Act, 1985 Complete Act

.....in the Official Gazette; (f) "prescribed" means prescribed by rules made under this Act; (g) "regulations" means the regulations made under this Act. Section 3 Taking over of management of Auditorium (1) On and from the appointed day, and for a period of fifteen years thereafter, the entire management and control of the Auditorium shall, by virtue of this Act, vest in the State Government. (2) Upon the vesting of the management and control of the Auditorium in the State Government under sub-section (1), the State Government may, for efficient management and control thereof, provide by notification for the transfer of the management and control of the Auditorium to the Committee with effect from such date as may be specified in the notification.
