MOTOR VEHICLES (WEST BENGAL AMENDMENT) ACT, 1985 35 of 1985 18th February, 1986 An Act to amend the Motor Vehicles Act, 1939, in its application to West Bengal. WHEREAS it is expedient to amend the Motor Vehicles Act, 1939, in its application to West Bengal, for the purposes and in the manner hereinafter appearing; It is hereby enacted as follows Section 1 Short title and commencement (1) This Act may be called the Motor Vehicles (West Bengal Amendment) Act, 1985. (2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint. Section 2 Application of the Act The Motor Vehicles Act, 1939 (hereinafter referred to as the principal Act), shall, in its application to West Bengal, be amended for the purposes and in the manner hereinafter provided. Section 3 Amendment of section 45 of Act 4 of 1939 In section 45 of the principal Act, in sub-section (1), after the words "Every application for a permit", the following words shall be inserted : "shall be accompanied by a receipt of profession tax paid by the owner of the vehicle or vehicles under any law for the time being in force and". Section 4 Amendment of section 58 In section 58 of the principal Act, in sub-section (2), after the second proviso, the following proviso shall be added: "Provided also that every application for renewal of a permit shall be accompanied by a receipt of profession tax paid by the owner of the vehicle or under any law for the time being in force."
