Indian Tolls (West Bengal Amendment) Act, 1978 Complete Act

.....hereinafter appearing; It is hereby enacted as follows:- Section 1 Short title This Act may be called the Indian Tolls (West Bengal Amendment) Act, 1978. Section 2 Application of the Act The Indian Tolls Act, 1851 (hereinafter referred to as the said Act), shall, in its application to West Bengal, be amended in the manner hereinafter provided. Section 3 Substitution of new section for section 4 of Act 8 of 1851 For section 4 of the said Act, the following section shall be substituted:- "4. Exemptions from payment of toll.- (1) No tolls shall be paid for the passage of Members of Parliament and Members of the West Bengal Legislative Assembly and their vehicles, or for the passage of Police Officers on duty or of any person or property in their custody, or for the passage of any vehicle belonging to the Government of West Bengal with persons on board. (2) The State Government may, by order, exempt from payment of tolls, for such area and for such period as it may specify,- (a) the passage of vehicles with persons on board, engaged in relief operations, procurement and transport of foodgrains and election-duty or in any other urgent Government work, as it may determine;.....

Motor Transport Workers (West Bengal Amendment) Act, 1978 Complete Act

.....appearing; It is hereby enacted as follows Section 1 Short title This Act may be called the Motor Transport Workers (West Bengal Amendment) Act, 1978 Section 2 Application of the Act The Motor Transport Workers Act, 1961 (hereinafter referred to as the said Act) shall, in its application to West Bengal, be amended in the manner hereinafter provided. Section 3 Insertion of new section 20A in Act 27 qf 1961. In the said Act, in Chapter V, after section 20, the following section shall be inserted : "20A. Issue of appointment letter. Notwithstanding anything in any contract, custom or usage to the contrary, in every motor transport undertaking engaged in carrying passengers, the employer shall issue to the motor transport worker a letter of appointment specifying therein (i) the name of the employer, (ii) the address of the employer, (iii) the registration number of the motor transport undertaking, (iv) the name and address of the motor transport worker with designation, (v) the date of appointment of the motor transport worker, (vi) the term of appointment, that is to say, whether appointed on permanent or temporary or casual or any other basis, (vii) the rate, or.....

WEST BENGAL MUNICIPAL EMPLOYEES (COMPULSORY RETIREMENT) REPEALING ACT, 1978 WEST BENGAL MUNICIPAL EMPLOYEES (COMPULSORY RETIREMENT) REPEALING ACT, 1978 9 of 1978 28th March, 1978 An Act to repeal the West Bengal Municipal Employees (Compulsory Retirement) Act, 1976. WHEREAS it is considered proper to repeal the West Bengal Municipal Employees (Compulsory Retirement) Act, 1976; It is hereby enacted as follows: Section 1 Short title and commencement (1) This Act may be called the West Bengal Municipal Employees (Compulsory Retirement) Repealing Act, 1978. (2) It shall be deemed to have come into force on the 23rd day of December. 1977. Section 2 Repeal of West Ben., Act 2 of 1976 The West Bengal Municipal Employees (Compulsory Retirement) Act, 1976, is hereby repealed. Section 3 Repeal The West Bengal Municipal Employees (Compulsory Retirement) Repealing Ordinance, 1977, shall stand repealed. West Bengal State Acts

West Bengal Legislative Assembly Proceedings (Protection of Publication) Act, 1978 Complete Act

.....of reports of Assembly proceedings (1) Save as otherwise provided in sub-section (2), no person shall be liable to any proceedings civil or criminal, in any court in respect of publication in a newspaper of a substantially true report of any proceedings of the West Bengal Legislative Assembly, unless the publication is proved to have been made with malice. (2) Nothing in sub-section (1) shall be construed as protecting the publication of any matter which is not for the public good. Section 4 Act also to apply to proceedings broadcast by wireless telegraphy The Act shall also apply in relation to reports or matters broadcast by means of wireless telegraphy as part of any programme or service provided by means of a broadcasting station as it applies in relation to reports or matters published in a newspaper. .....hereinafter appearing; It is hereby enacted as follows:- Section 1 Short title This Act may be called the Motor Vehicles (West Bengal Amendment) Act, 1978. Section 2 Application of the Act The Motor Vehicles Act, 1939 (hereinafter referred to as the said Act), shall, in its application to West Bengal, be amended in the manner hereinafter provided. Section 3 Amendment of section 46 of Act 4 of 1939 In section 46 of the said Act, after clause (e), the following clause shall be inserted, namely: "(ee) such particulars as may be applicable to the applicant with respect to matters referred to in the provisos to sub-section (1) of section 47;". Section 4 Amendment of section 47 In section 47 of the said Act, for the proviso to sub-section (1), the following provisos shall be substituted, namely: "Provided that other conditions being equal, an application for a stage carriage permit from a partnership firm or a private limited company or a public limited company or a co-operative society registered or deemed to have been registered under any enactment in force for the time being or a group of individuals shall, as far as may be, given preference over applications from.....

Motor Vehicles (West Bengal Second Amendment) Act, 1978 Complete Act

.....appearing; It is hereby enacted as follows: Section 1 Short title This Act may be called the Motor Vehicles (West Bengal Second Amendment) Act, 1978. Section 2 Application of the Act The Motor Vehicles Act, 1939 (hereinafter referred to as the said Act), shall, in its application to West Bengal, be amended in the manner hereinafter provided. Section 3 Amendment of section 47 of Act 4 of 1939 In section 47 of the said Act, in sub-section (1), (a) in clause (f), for the words "or area;", the words "or area;" shall be substituted; (b) the words beginning with "and shall also take into consideration" and ending with "route or area lies:" shall be omitted. Section 4 Amendment of section 48 In sub-section (3) of section 48 of the said Act, for clause (xxi), the following clause shall be substituted: "(xxi) that the Regional Transport Authority may, after giving notice of not less than one month, (a) vary the conditions of the permit, subject to the limitation that, in no case, the distance covered by the original route shall be altered by more than 24 kilometres whether or not any such condition has been specified in the permit in pursuance of clause (i), (b) attach.....

Burdwan University (Temporary Supersession) Act, 1978 Complete Act

.....by resignation, death or otherwise during the period of supersession shall be filled up by the Chancellor in consultation with the Vice-Chancellor and the Minister, in so far as it is not inconsistent with this Act. Section 6 Power to remove difficulties If in view of the provisions of the Burdwan University Act, 1959 any difficulty arises in giving effect to the provisions of this Act, the Council shall refer the difficulty to the State Government which may make such order or do such thing not inconsistent with the provisions of this Act, as appears to it to be necessary or expedient for removing that difficulty. Section 7 The University to continue as a body corporate Nothing in this Act shall be construed as effecting or implying in any way the dissolution of the University as a body corporate as described in section 3 of the Act. Section 8 Repeal and savings (1) The Burdwan University (Temporary Supersession) Ordinance, 1978, is hereby repealed. (2) Anything done or any action taken under the said Ordinance shall be deemed to have been validly done or taken under this Act. West Bengal State Acts

.....which it or the remedy for the enforcement thereof was suspended, shall be excluded. Section 13 Act to have overriding effect The provisions of this Act or any order or rule made thereunder shall have effect notwithstanding anything inconsistent therewith contained in any other law or any instrument having effect by virtue of any other law. Section 14 Power to remove difficulties If any difficulty arises in giving effect to the provisions of this Act, the State Government may take such steps or issue such orders not inconsistent with the provisions of this Act, as may be necessary for the removal of the difficulty. Section 15 Power to make rules (1) The State Government may make rules for carrying out the purposes of this Act. (2) In particular, and without prejudice to the generality of the foregoing power, such rules may provide for (a) the management of the Bangabasi Group of Colleges; (b) the terms and conditions of service of the Administrator and other person or persons appointed to assist the Administrator; and (c) the rate of interest in respect of money advanced by the State Government to the Administrator.
