Finance Act, 1986 Section 6

Title: Amendment of Section 24

State: Central

In section 24 of the Income-tax Act, for sub-section (2), the following sub-sections shall be substituted with effect from the 1st day of April, 1987, namely :- "(2) No deduction shall be allowed under sub-section (1) in respect of property of the nature referred to in sub-clause (i) of clause (a) of sub-section (2), or sub-section (3), of section 23 : Provided that nothing in this sub-section shall apply to the allowance of a deduction under clause (vi) of sub-section (1) of an amount not exceeding five thousand rupees in respect of the property of the nature referred to in sub-clause (i) of clause (a) of sub-section (2) of section 23. (3) The total amount deductible under sub-section (1) in respect of property of the nature referred to in sub-clause (ii) of clause (a) of sub-section (2) of section 23 shall not exceed the annual value of the property as determined under that section."

Consumer Protection Act, 1986 Section 6

Title: Objects of the Central Council

The objects of the Central Council shall be to promote and protect the rights of the consumers such as,-- (a) the right to be protected against the marketing of goods1[and services] which are hazardous to life and property; (b) the right to be informed about the quality, quantity, potency, purity, standard and price of goods1[or services, as the case may be] so as to protect the consumer against unfair trade practices; (c) the right to be assured, wherever possible, access to a variety of goods1[and services] at competitive prices; (d) the right to be heard and to be assured that consumer's interests will receive due consideration at appropriate fora; (e) the right to seek redressal against unfair trade practices1for restrictive trade practices] or unscrupulous exploitation of consumers; and (f) the right to consumer education. _______________________ 1. Swadeshi Cotton Mills Company Limited (Acquisition and Transfer of Undertakings) Act, 1986 Chapter VI

Title: Commissioner of Payments

.....S.O. 265(E), dated the 13th April, 1978, issued under clause (a) of sub-section (1) of section 18AA of the Industries (Development and Regulation) Act, 1951. Section 18 - Claims to be made to the Commissioner Every person having a claim against the Company in relation to the textile undertakings with regard to any of the matters specified in the Schedule shall prefer such claim before the Commissioner within thirty days from the specified date : Provided that if the Commissioner is satisfied that the claimant was prevented by sufficient cause from preferring the claim within the said period of thirty days, he may entertain the claim within a further period of thirty days, but not thereafter. Section 19 - Priorities of claims The claims arising out of matters specified in the Schedule shall have priorities in accordance with the following principles namely : (a) Category I shall have precedence over all other categories and Category II shall have precedence over Category III and so on; (b) the claims specified in each of the categories, shall rank equally and be paid in full, but, if the amount is insufficient to meet such claims in full, they shall abate in equal.....

Swadeshi Cotton Mills Company Limited (Acquisition and Transfer of Undertakings) Act, 1986 Section 6

Title: Transfer of Any Textile Undertaking or Part Thereof to a Subsidiary Textile Corporation

(1) The National Textile Corporation may, by order in writing, transfer any of the textile undertakings or part thereof to a Subsidiary Textile Corporation and any such transfer shall be subject to such terms and conditions as may be specified in the said order. (2) The Subsidiary Textile Corporation shall, on and from the date of such transfer, be deemed to be substituted in the licence or other instrument referred to in sub-section (3) of section 4 in place of the National Textile Corporation as if such licence or other instrument had been granted to the Subsidiary Textile Corporation, and shall hold such licence or other instrument for the remainder of the period for which the National Textile Corporation would have held such licence or other instrument. (3) Save as otherwise expressly provided in this Act, references in this Act to the National Textile Corporation shall, in respect of any textile undertaking or part thereof which is transferred to a Subsidiary Textile Corporation, be construed as references to the Subsidiary Textile Corporation.

National Law School of India Act, 1986 Section 6

Title: Teaching of the School

(1) All recognised teaching in connection with the degree, diplomas and certificates of the School shall be conducted, under the control of the General Council, by the teachers of the School, in accordance with the syllabus prescribed by the regulations. (2) The courses and curricula and the authorities responsible for organising such teaching shall be as prescribed by the regulations.

Co-operative Textile Mills (Acquisition and Transfer) Act, 1986 Chapter VI

Title: Provisions Relating to the Employees of the Mills

.....the Act or under any other laws for the time being in force and no such claim shall be entertained by any court, tribunal or other authority. Section 25 - Transfer of provident fund, welfare fund, etc. (1) Where the mills has established a provident fund, superannuation fund, welfare fund or any other fund for the benefit of the persons employed in the mills the money relatable to the officers or other employees, whose services have become transferred, by or under this Act to the Company shall, out of the money standing on the date of vesting specified under section 8 to the credit of such provident fund, superannuation fund, welfare fund or other fund, stand transferred to and vest in the Company. (2) The money which stand transferred under sub-section (1) to the Company shall be dealt with by the Company in such manner as may be prescribed.

Co-operative Textile Mills (Acquisition and Transfer) Act, 1986 Section 6

Title: Lessor or Lessee to Be Liable for Certain Prior Liabilities

.....become due and payable. (3) For the removal of doubts, it is hereby declared that,- (a) save as otherwise expressly provided in this section or in any other section of the Act, no liability, other than the liability specified in sub-section (2), of the lessor or lessee in relation to the mills in respect of any period prior to the appointed day shall be enforceable against the Government, or where the mills is directed under section 8 to vest in the Company, against the Company. (b) No award, decree or order of any court, tribunal or other authority in relation to the mills passed after the appointed day in respect of any matter, claim or dispute in relation to any matter not referred in sub-section (2), which arose before that day, shall be enforceable against the Government or where the mills is directed under section 8 to vest in the Company, against the Company. (c) No liability incurred by the lessor or lessee before the appointed day for the contravention of any provisions of law for the time being in force shall be enforceable against the Government or where the mills is directed under section 8 to vest in the Company, against the Company.

Title: Term of Office and Conditions of Service

(1) notwithstanding anything contained in section 7, every nominated member shall hold office during the pleasure of the State Government and their condition of service shall be such as may be prescribed. (2) Subject to the provisions of sub-section (1) every nominated member shall hold office for three years from the date of nomination, but be shall be eligible for re-nomination. (3) Every nominated member may at time resign his office by a letter of resignation addressed to the State Government: Provided that the resignation shall not take effect until it is accepted.
