Public Servants (Inquiries) Act, 1850 Section 8

Title: Powers of Commissioners. their Protection. Service of their Process. Powers of Court, Etc., Acting Under Commission

The Commissioners shall have the same power of punishing contempts and obstructions to their proceedings, as is given to Civil and Criminal Courts by 1 [the Code of Criminal Procedure, 1898], and shall have the same powers for the summons of witnesses, and for compelling the production of documents, and for the discharge of their duty under the commission, and shall be entitled to the same protection as the Zila and City Judges, except that all process to cause the attendance of witnesses or other compulsory process, shall be served through and executed by the Zila or City Judge in whose jurisdiction the witness or other person resides, on whom the process is to be served, and if he resides within Calcutta, Madras or Bombay, then through the Supreme Court of Judicature thereto. When the commission has been issued to a Court, or other person or persons having power to issue such process in the exercise of their ordinary authority, they may also use all such power for the purposes of the commission. _____________________________ 1. Where under any provision of this Act any permission or licence has been given or granted to any person subject to any conditions and- (i) such person fails to comply with all or any of such conditions; or (ii) any other person abets such person in not complying with all or any of such conditions, then, for the purposes of this Act- (a) in a case referred to in clause (i), such person shall be deemed to have contravened of such provision; and (b) in a case referred to in clause (ii), such other person shall be deemed to have abetted the contravention of such provision.

Title: Factors to Be Taken into Account by the Central Government and the Reserve Bank While Giving or Granting Permissions or Licences Under the Act

Save as otherwise expressly provided in this Act, the Central Government or the Reserve Bank, as the case may be, shall, while giving or granting any permission or licence under this Act, have regard to all or any of the following factors, namely- (i) conservation of the foreign exchange resources of the country; (ii) all foreign exchange accruing to the country is properly accounted for; (iii) the foreign exchange resources of the country are utilised as best to subserve the common good; and (iv) such other relevant factors as the circumstances of the case may require.

Title: Dissolution of the Institute of Cost and Works Accountants Registered Under the Companies Act, 1956

On the commencement of this Act,-- (a) the company known as the Institute of Cost and Works Accountants registered under the Companies Act, 1956, shall be dissolved and thereafter no person shall make, assert or take any claims, demands or proceedings against the dissolved company or against any officer thereof in his capacity as such officer except in so far as may be necessary, for enforcing the provisions of this Act; (b) the right of every member to or in respect of the dissolved company shall be extinguished, and thereafter no member of that company shall make, assert or take any claims or demands or proceedings in respect of that company except as provided in this Act.

Whenever the terms or conditions, or the extent or operation of any security interest registered under this Chapter are or is modified, it shall be the duty of the securitisation company or the reconstruction company or the secured creditors, as the case may be, to send to the Central Registrar, the particulars of such modification, and the provisions of this Chapter as to registration of a security interest shall apply to such modification of such security interest.
