THE AMBERNATH INTERIM MUNICIPALITY (CONSTITUTION AND ACTIONS) VALIDATION ACT, 1965 [Act No. 49 of 1965]1 [14th December, 1965] PREAMBLE An Act to validate the constitution of an interim municipality for Ambernath municipal district and to make certain consequential provisions upon conversion of village panchayat into a municipality. WHEREAS, by Government Notification, Local Self-Government and Public Health Department, No. DTM. 2553/A, dated the 6th May, 1959, issued under section 4 of the Bombay District Municipal Act, 1901 (Bom. III of 1901), the State Government declared the local area specified therein which was within the limits of certain village to be a permanent municipal district with effect from the 11th May, 1959 under the name of the municipal district of Ambernath; AND WHEREAS, relying on section 191-B of the said District Municipal Act as it stood before its amendment by Bombay Act VIII of 1959 (which came into force on the 13th March, 1959), the persons vacating office as members of the village panchayat constituted an interim municipality for the newly created municipal district with effect from the 11th May, 1959, with the Sarpanch and Deputy.....

Title: Breath Tests

(6) The results of a breath test made in pursuance, of the provisions of this section shall be admissible in evidence. Title: Laboratory Test

.....required, whether at the hospital or elsewhere, to provide a specimen of breath for a breath test, has refused, omitted or failed to do so and a police officer has reasonable cause to suspect him of having alcohol in his blood: Provided that a person shall not be required to provide a specimen of his blood for a laboratory test under this sub-section if the registered medical practitioner in immediate charge of his case is not first notified of the proposal to make the requirement or objects to the provision of such specimen on the ground that its provision or the requirement to provide it would be prejudicial to the proper care or treatment of the patient. (3) The results of a laboratory test made in pursuance of this section shall be admissible in evidence. Explanation.For the purposes of this section, "laboratory test" means the analysis of a specimen of blood made at a laboratory established, maintained or recognised by the Central Government or a State Government.

Petroleum Act, 1934 (30 of 1934) Section 20

Title: Right to Require Re-test

(1) The owner of any petroleum, or his agent, who is dissatisfied with the result of the test of the petroleum may, within seven days from the date on which he received intimation of the result of the test, apply to the officer empowered under section 14 to have fresh samples of the petroleum taken and tested. (2) On such application and on payment of the prescribed fee, fresh samples of the petroleum shall be taken in the presence of such owner or agent or person deputed by him, and shall be tested in the presence of such owner or agent or person deputed by him. (3) If, on such re-test, it appears that the original test was erroneous the testing officer shall cancel the original certificate granted under section 19, shall make out a fresh certificate, and shall furnish the owner of the petroleum, or his agent, with a certified copy thereof, free of charge.

Title: Certification of Other Test Apparatus

Constitution of Central Seed Testing Laboratories.- (1) The Committee may, by order, establish the Central Seed Testing Laboratories and accredit the existing laboratories of the Board or the State Governments having such facilities as may be specified by regulations. (2) The Central Seed Testing Laboratories and the accredited laboratories shall carryout such functions as may be entrusted to it by the Committee from time to time. (1) Every applicant shall, along with the application for registration made under this Act, make available to the Registrar such quantity of seed of a variety for registration of which such application is made, for the purpose of conducting tests to evaluate whether, seed of such variety along with parental material conform to the standards as may be specified by regulations: Provided that the Registrar or any person or test centre to whom such seed has been sent for conducting lest shall keep such seed during his or its possession in such manner and in such condition that its viability and quality shall remain unaltered. (2) The applicant shall deposit such fees as may be prescribed for conducting tests referred to in sub- section (1). (3) The tests referred to in sub-section (1) shall be conducted in Such manner and by such method as may be prescribed.
