THE KERALA STAY OF EVICTION PROCEEDINGS (AMENDMENT) ACT, 1969 [1] ACT 5 OF 1969 THE KERALA STAY OF EVICTION PROCEEDINGS (AMENDMENT) ACT, 1969 [1] An Act to amend the Kerala Stay of Eviction Proceedings Act, 1967. Preamble ." WHEREAS it is expedient to amend the Kerala Stay of Eviction Proceedings Act, 1967, for the purposes hereinafter appearing; Be it enacted in the Twentieth Year of the Republic of India as follows:" 1. Short title and commencement . " (1) This Act may be called the Kerala Stay of Eviction Proceedings (Amendment) Act, 1969. (2) It shall come into force at once. 2. Amendment of section 1 ." In sub-section (3) of section 1 of the Kerala Stay of Eviction Proceedings Act, 1967 (9 of 1967) (herein after referred to as the principal Act), for the figures, letters and words "31st day of December 1968", the figures, letters and words "31st day of December 1969" shall be substituted. 3. Substitution of new sections for section 2 ." For section 2 of the principal Act, the following sections shall be substituted, namely: " "2. Definition ." In this Act, unless the context otherwise requires," (i) the terms "jenmi", "jenmikaram" and "kanam tenant" shall.....

AND WHEREAS, the Kerala Stay of Eviction Proceedings Ordinance, 2001 (26 of 2001) was promulgated by the Governor on 13th March, 2001, extending the period of operation of Act 26 of 1999 for a further period of one year; AND WGEREAS, the Kerala Stay of Eviction Proceedings Act, 2001 (11 of 2001) was enacted giving period of operation from 18th July, 2001 to 31st March, 2003, as the said Ordinance had ceased to operate on the 17th July, 2001 under the provisions of sub-clause (a) of clause (2) of Article 213 of the Constitution; AND WHEREAS, the Kerala Stay of Eviction Proceedings (Amendment) Act, 2003 (8 of 20030 was enacted extending the period of operation of Act 11 of 2001 for a further period of one year, the period of operation of which had expired on 31st.....

Preamble .- WHEREAS, it is expedient to amend the Kerala Temporary Stay of Eviction Proceedings Act, 2007 for the purposes hereinafter appearing; Be it enacted in the Sixtieth Year of the Republic of India as follows:- 1. Short title and commencement.- (1) This Act may be called the Kerala Temporary Stay of Eviction Proceedings (Amendment) Act, 2009. (2) It shall be deemed to have come into force on the 26th day of July, 2008. 2. Amendment of section 2.- In sub-section (1) of section 2 of the Kerala Temporary Stay of Eviction Proceedings Act, 2007 (14 of 2007) (hereinafter referred to as the principal Act), for the words "stayed for a period of two years", the words "stayed for a period of four years" shall be substituted. 3. Special provision.- Notwithstanding the expiry of the period of the stay of eviction proceedings under section 2 of the principal Act, anything done or any action taken, after the expiry of such period.....

.....Definition In this Act, the expression "thika tenant" and "Bharatia" have the meanings respectively assigned to them in the Calcutta Thika Tenancy Act, 1949. Section 3 Stay of proceedings for ejectment of thika tenants Notwithstanding anything contained in the Calcutta Thika Tenancy Act, 1949, or in any other law for the time being in force, (a) all applications for ejectment of thika tenants, (b) all appeals from orders made on such applications, and (c) all proceedings in execution of orders for ejectment of thika tenants, under the provisions of the Calcutta Thika Tenancy Act, 1949, which are pending at the date of commencement of this Act or which may be made, preferred or commenced after such date but before the expiry of this Act, in respect of any land which is not a 'vacant land' within the meaning of the Urban Land (Ceiling and Regulation) Act, 1976, shall be stayed for the period during which this Act continues in force. Section 4 Stay of suits and proceedings against Bharatias No thika tenant shall, while this Act continues in force, commence, or continue with, any suit, appeal or proceedings in execution of orders, for ejectment of any Bharatia and all pending.....
