AND WHEREAS, the Kerala Stay of Eviction Proceedings Ordinance, 2001 (26 of 2001) was promulgated by the Governor on 13th March, 2001, extending the period of operation of Act 26 of 1999 for a further period of one year; AND WGEREAS, the Kerala Stay of Eviction Proceedings Act, 2001 (11 of 2001) was enacted giving period of operation from 18th July, 2001 to 31st March, 2003, as the said Ordinance had ceased to operate on the 17th July, 2001 under the provisions of sub-clause (a) of clause (2) of Article 213 of the Constitution; AND WHEREAS, the Kerala Stay of Eviction Proceedings (Amendment) Act, 2003 (8 of 20030 was enacted extending the period of operation of Act 11 of 2001 for a further period of one year, the period of operation of which had expired on 31st.....

.....TEMPORARY STAY OF EVICTION PROCEEDINGS (AMENDMENT) ACT, 2009 ACT 27 OF 2009 THE KERALA TEMPORARY STAY OF EVICTION PROCEEDINGS (AMENDMENT) ACT, 2009 An Act to amend the Kerala Temporary Stay of Eviction Proceedings Act, 2007. Preamble .- WHEREAS, it is expedient to amend the Kerala Temporary Stay of Eviction Proceedings Act, 2007 for the purposes hereinafter appearing; Be it enacted in the Sixtieth Year of the Republic of India as follows:- 1. Short title and commencement.- (1) This Act may be called the Kerala Temporary Stay of Eviction Proceedings (Amendment) Act, 2009. (2) It shall be deemed to have come into force on the 26th day of July, 2008. 2. Amendment of section 2.- In sub-section (1) of section 2 of the Kerala Temporary Stay of Eviction Proceedings Act, 2007 (14 of 2007) (hereinafter referred to as the principal Act), for the words "stayed for a period of two years", the words "stayed for a period of four years" shall be substituted. 3. Special provision.- Notwithstanding the expiry of the period of the stay of eviction proceedings under section 2 of the principal Act, anything done or any action taken, after the expiry of such period.....

Title: Power of Court to Issue Injunction Prohibiting Child Marriages

.....the issue of the injunction: Provided that in the case of any urgency, the Court shall have the power to issue an interim injunction without giving any notice under this section. (7) An injunction issued under sub-section (1) may be confirmed or vacated after giving notice and hearing the party against whom the injunction was issued. (8) The Court may either on its own motion or on the application of any person aggrieved, rescind or alter an injunction issued under sub-section (1). (9) Where an application is received under sub-section (1), the Court shall afford the applicant an early opportunity of appearing before it either in person or by an advocate and if the Court, after hearing the applicant rejects the application wholly or in part, it shall record in writing its reasons for so doing. (10) Whoever knowing that an injunction has been issued under sub-section (1) against him disobeys such injunction shall be punishable with imprisonment of either description for a term which may extend to two years or with fine which may extend to one lakh rupees or with both: Provided that no woman shall be punishable with imprisonment.

.....Definition In this Act, the expression "thika tenant" and "Bharatia" have the meanings respectively assigned to them in the Calcutta Thika Tenancy Act, 1949. Section 3 Stay of proceedings for ejectment of thika tenants Notwithstanding anything contained in the Calcutta Thika Tenancy Act, 1949, or in any other law for the time being in force, (a) all applications for ejectment of thika tenants, (b) all appeals from orders made on such applications, and (c) all proceedings in execution of orders for ejectment of thika tenants, under the provisions of the Calcutta Thika Tenancy Act, 1949, which are pending at the date of commencement of this Act or which may be made, preferred or commenced after such date but before the expiry of this Act, in respect of any land which is not a 'vacant land' within the meaning of the Urban Land (Ceiling and Regulation) Act, 1976, shall be stayed for the period during which this Act continues in force. .....of the Republic of India as follows:- 1. Short title and commencement.--(1) This Act may be called the Kerala Stay of Eviction Proceedings (Amendment) Act, 2003. (2) It shall be deemed to have come into force on the 29th day of March, 2003. 2. Amendment of section 1.--In the Kerala Stay of Eviction Proceedings Act, 2001 (11of 2001) (hereinafter referred to as the principal Act) in sub-section (3) of section 1, for the figures and word "31st March, 2003", the figures and word "31st March, 2004" shall be substituted. 3. Repeal and saving.--(1) The Kerala Stay of Eviction Proceedings (Amendment) Ordinance, 2003 (1 of 2003), is hereby repealed. (2) Notwithstanding such repeal, anything done or deemed to have been done or any action taken or deemed to have been taken under the principal Act as amended by the said Ordinance shall be deemed to have been done or taken under the principal Act, as amended by this Act.
