THE MERGED STATES ( LAWS ) ACT, 1949 [Act, No. 59 of 1949] [AS ON 1956] {This Act was not adapted by the A.O.1950} [ 26th December, 1949 ] PREAMBLE An Act to extend certain laws to certain areas administered as parts of Governors Provinces or as Chief Commissioners Provinces. WHEREAS by Orders under section 290 A of the Government of India Act, 1935 (25 and 26 Geo.5, c.2), provision has been made for the administration of certain areas either as if they formed part of an adjoining Governor's Province or as if they were a Chief Commissioners Provinces; AND WHEREAS it is expedient to provide that certain laws should be extended to, and by virtue of such extension, be in force in, the said areas; It is hereby enacted as follows :-

.....to it under the Taxation on Income(Investigation Commission) Act, 1947 (XXX of 1947), and shall be entitled to act forthe same term as under sub-section (3) of section 4 of that Act: (bb)any decision given, whether before or after the commencement of this Act, by theChief Revenue Authority of Travancore or of Travancore-Cochin in the exercise orpurported exercise of any powers conferred on it by any law for the time beingin force in the State shall be deemed to be a decision given by the Income-taxauthority for the purposes of sub-section (2) of section 8 of the TravancoreTaxation on Income (Investigation Commission) Act, 1124 (Travancore Act XIV of1124);] (c) any reference in the State law, by whatever form ofwords, to the State Government or the State Commission shall, in relation toincome other than agricultural income, be construed as a reference to theCentral Government or the Central Commission, as the case may be ; (d) the report of the Central Commission shall besubmitted to the Central Government, and the Central Government may, by order inwriting, direct that such proceedings as it thinks fit under the law in force inthe State relating to income-tax, super-tax.....

Title: Validation of State Laws Imposing, or Authorizing the Imposition Of, Taxes on Sale or Purchase of Goods in the Course of Inter-state Trade or Commerce

Notwithstanding any judgment, decree or order of any court, no law of a State imposing, or authorising the imposition of, a tax on the sale or purchase of any goods where such sale or purchase took place in the course of inter-State trade or commerce during the period between the 1st day of April, 1951 and the 6th day of September, 1955, shall be deemed to be invalid or ever to have been invalid merely by reason of the fact that such sale or purchase took place; in the course of inter-State trade or commerce; and all such taxes levied or collected or purporting to have been levied or collected during the aforesaid period shall be deemed always to have been validly levied or collected in accordance with law. Explanation.In this section, law of a State in relation to a State specified in Part C of the First Schedule to the Constitution, means any law made by the Legislative Assembly, if any, of that State or extended to that State by a notification issued under section 2 of the Part C States (Laws) Act, 1950, 30 of 1950.

.....to that State, and shall continue to be in force accordingly, unless and until superseded by anything done or any action taken under the said Act or Ordinance. SECTION 07: POWER TO REMOVE DIFFICULTIES -(1) If any difficulty arises in giving effect in any Part B State to the provisions of any Act or Ordinance now extended to that State, the Central Government may, by order notified in the Official Gazettee, make such provisions or give such directions as appear to it to be necessary for the removal of the difficulty. (2) In particular, and without prejudice to the generality of the foregoing power, any such notified order may- (a) specify the corresponding authorities within the meaning of section 5-; (b) provide for the transfer of any matter pending before any Court, tribunal or other authority, immediately before the appointed day, to any corresponding Court, tribunal or other authority for disposal; (c) specify the areas or circumstances in which, or the extent to which or conditions subject to which, anything done or any action taken (including any of the matters specified in the second proviso to section(6)-under any law repealed by that section shall be recognised.....

.....and Regulation to the said areas. It is hereby enacted as follows SECTION 01: SHORT TITLE This Act may be called the Bombay Merged States (Laws) Act, 1950. SECTION 02: DEFINITIONS In this Act, the expression "merged States" has the same meaning as in the State's Merger (Governor's Provinces) Order, 1949. SECTION 03: EXTENSION OF LAWS (1) All the Acts and Regulations specified in the First Schedule, and so much of the Acts and Ordinance specified-in the Second Schedule as relates to matters with respect to which the State Legislature has power to make laws are hereby extended to, and shall be in force in the merged States. (2) The Acts specified in the first column of the Third Schedule shall be amended in their application to the merged States specified in the second column in the manner set forth in the third column of that Schedule. (3) (a) Subject to the provisions of clause (b) and the proviso to sub -section (1) of Section 4, all appointments, delegations, notifications, orders, bye -laws, rules and regulations made, issued or prescribed under any Act, Ordinance or regulation hereby extended to the merged States shall be deemed to extend to and be in force in the merged.....
