To section 8 of the principal Act, the following proviso shall be added, namely:-- "Provided that where a person has abetted the contravention of any order for the purpose of procuring any essential commodity of the nature mentioned in sub-clause (iva) or sub-clause (v) of clause (a) of section 2 for his own use or for the use of any member of his family or for the use of any person dependent on him, and not for the purpose of carrying on any business or trade in such essential commodity, the court may, not with-standing anything contained in section 7 and for reasons to be mentioned in the judgment, impose a sentence of fine only.".

In section 8 of the principal Act, in sub-section (3), for the second proviso, the following proviso shall be substituted, namely:-- "Provided further that the Apprenticeship Adviser may, on a representation made to him by an employer and keeping in view the mare realistic employment potential, training facilities and other relevant factors, permit him to engage such number of apprentices for a designated trade as is lesser than the number arrived at by the ratio for that trade, not being lesser than fifty per cent. of the number so arrived at, subject to the condition that the employer shall engage apprentices in other trades in excess in number equivalent to such shortfall.".

For section 8 of the principal Act, the following section shall be substituted, namely:-- Term of office "8. (1) The Chairman shall hold office as such for a term of five years from the date on which he enters upon his office: Provided that no Chairman shall hold office as such after he has attained the age of sixty-eight years. (2) A Member shall hold office as such for a term of five years from the date on which he enters upon his office extendable by one more term of five years: Provided that no Member shall hold office as such after he has attained the age of sixty-five years. (3) The conditions of service of Chairman and Members shall be the same as applicable to Judges of the High Court.".

Terms and conditions of service of Chairperson and Members.--The salaries and allowances payable to, and the other terms and conditions of service of, the Chairperson and Members shall be such as may be prescribed: Provided that neither the salary and allowances nor the other terms and conditions of service of the Chairperson or a Member shall be varied to his disadvantage after his appointment.".
