Control of National Highways (Land and Traffic) Act, 2002 Chapter 6

Title: Regulation of Construction on Highway Land for Public Utilities, Drains, Etc.

.....person the expenditure, if any, incurred by the Highway Administration for repairing any damage caused to the Highway by laying or shifting of any structure, article or equipment under the permission. (4) If any person, in contravention of sub-section (1), makes any construction or carries out any other work, the Highway Administration may, at its own expenses, cause such construction or other work to be removed from the Highway and restore the Highway in the condition as it was immediately before giving permission for such construction or other work under sub-section (3) and such expenses together with fifteen per cent, thereof as additional charges and fine imposed by the Highway Administration taking into account the nature of the damages caused by such construction or other work, which shall not be less than five hundred rupees per square metre of land used for such construction or other work, but shall not exceed the cost of such land, shall be recovered from such person in accordance with the provisions contained in section 27 as if such expenses, additional charges and fine were the expenses, additional charges and fine recoverable under that section.

.....(4) Not more than one pass shall be issued per family or residence on the grounds of residence on a sealed or restricted road, and the mere fact that the residence or official work place is on a sealed or restricted road shall not entitle the grant of a pass. Section 5 - Exemption in certain cases No pass shall be required to drive a motor vehicle between 11.00 PM and 7.00 AM on a restricted road: Provided that Government in order to prevent annoyance or danger to vehicles and pedestrians may impose such reasonable restrictions (including declaration of roads as one way or no traffic roads for specified times of the day) in respect of any sealed or restricted road as may be necessary having regard to the circumstances of a particular sealed or restricted road. Title: In Respect of What Property Liability of Carrier Not Limited or Affected by Public Notice. Carriers, with Certain Exceptions, May Limit Liability by Special Contract

The liability of any common carrier for the loss of or damage to any 1[property (including container pallet or similar article of transport used to consolidate goods) delivered] to him to be carried, not being of the description contained in the Schedule to this Act, shall not be deemed to be limited or affected by any public notice; but any such carrier, not being the owner of a railroad or tramroad constructed under the provisions of Act 22 of 1863 (to provide for taking land for works of public utility to be constructed by private persons or Companies, and for regulating the construction and use of works on land so taken) may, by special contract, signed by the owner of such property so delivered as last aforesaid or by some person duly authorised in that behalf by such owner, limit his liability in respect of the same. _______________________ 1. Young Persons (Harmful Publication) Act, 1956 Section 6

Title: Power to Seize and Destroy Harmful Publications

(1) Any police officer or any other officer empowered in this behalf by the State Government may seize any harmful publication. (2) Any magistrate of the first class may, by warrant, authorise any police officer not below the rank of sub-inspector to enter and search any place where any stock of harmful publications may be or may be reasonably suspected to be, and such police officer may seize any publication found in such place if in his opinion it is a harmful publication. (3) Any publication seized under sub-section (1) shall be produced, as soon as may be, before a magistrate of the first class, and any publication seized under sub-section (2) shall be produced, as soon as may be, before the court which issued the warrant. (4) If in the opinion of the magistrate or court such publication is a harmful publication, the magistrate or court may cause it to be destroyed, but if, in the opinion of the magistrate or court, such publication is not a harmful publication, the magistrate or court shall dispose of it in the manner provided in sections 523, 524 and 525 of the Code of Criminal Procedure, 1898 (5 of 1898).
