THE IDENTIFICATION OF PRISONERS ACT, 19201 [Act, No. 33 of 1920] [9th September, 1920] PREAMBLE An Act to authorize the taking of measurements and photographs of convicts and others. WHEREAS it is expedient to authorize the taking of measurements and photographs of convicts and others; it is hereby enacted as follows:- ________________________ 1. For Statement of Objects and Reasons, see Gazette of India, 1920, Part V, p. 162; and for proceedings, in Council, see Gztette of India, 1920 Part VI, pp. 1037 and 1143. This Act has been amended in its application to Bombay by Bombay Acts 11 of 1922, 4 of 1935, 21 of 1935 and 56 of 1959. The Act has been repealed in its application to Bellary District by Mysore Act 14 of 1955.

Insertion of new Section 54-A--After Section 54, the following section shall be inserted, namely:-- "54-A. Test identification of the accused.-When a person is arrested on a charge of committing an offence and his test identification by any witness is considered necessary by any Court having jurisdiction, it shall be lawful for an Executive Magistrate acting at the instance of such Court, to hold test identification of the person arrested." Title: Prohibition of Sale of Transfer of Firearms Not Bearing Identification Marks

(1) No person shall obliterate, remove, alter or forge any name, number or other identification mark stamped or otherwise shown on a firearm. (2) No person shall sell or transfer any firearm which does not bear the name of the maker, manufacturer's number or other identification mark stamped or otherwise shown thereon in a manner approved by the Central Government. (3) Whenever any person has in his possession any firearm, without such name, number or other identification mark or on which such name, number or other identification mark has been obliterated, removed, altered or forged, it shall be presumed unless the contrary is proved, that he has obliterated, removed, altered or forged that name, number or other identification mark: Provided that in relation to a person who has in his possession at the commencement of this Act any firearm without such name, number or other identification mark stamped or otherwise shown thereon, the provisions of this sub-section shall not take effect until after the expiration of one year from such commencement.

THE KERALA IDENTIFICATION OF PRISONERS ACT, 1963 THE KERALA IDENTIFICATION OF PRISONERS ACT, 1963 (ACT 39 OF 1963) An Act to unify and amend the laws authorising the taking of measurements and photographs of convicts and others in the State of Kerala WHEREAS it is expedient to unify and amend the laws authorising the taking of measurements and photographs of convicts and others in the State of Kerala; BE it enacted in the Fourteenth Year of the Republic of India as follows:- 1. Short title, extent and commencement .-(1) This Act may be called the Kerala Identification of Prisoners Act, 1963. (2) It extends to the whole of the State of Kerala. (3) It shall come into force at once. 2. Definitions .-In this Act, unless the context otherwise requires,- (a) "measurements" include finger impressions and foot-print impressions ; (b) "Police Officer" means an officer in charge of a police station, a police officer making an investigation under Chapter XIV of the Code of Criminal Procedure, 1898 (Central Act 5 of 1898), or any other police officer not below the rank of a Sub Inspector; (c) "prescribed" means prescribed by rules made under this Act. 3.
