Coal Mines (Nationalisation) Act, 1973 Complete Act

.....the above two Acts. Some of the important amendments which the Ordinance proposed were as follows:- (a) the definition of "mine'' inthe Coking Coal Actandthe Coal Mines Actincluded all coal and coke belonging to the owner of the mine whether in stock or in transit and all coal under production in a mine on a day immediately prior to the date on which the coal mines were nationalised. Accordingly, the amounts specified in the Schedules to the two Acts included the value of the coke and coal in stock lying at the mines at the time of nationalisation. The Supreme Court, however, in a recent case, while agreeing with the contention that the coke and coal stocks lying at the mine vested in the Government as a result of nationalisation, took the view that the value of coke and coal stocks had to be taken into account for balancing the position of accounts as on the date immediately preceding the date of nationaliiation. This would have involved double payment of the amount in as much as the value of the coke and coal stocks had already been included in the amounts mentioned in the Schedules to the Acts against each coal mine. .....take over, or carry on. the management of the coal mine: (e) "Government company "has the mean ing assigned to it bysection 617 of the Companies Act, 1956-: (f) "managing contractor" means inc person, or body of persons, who. with the previous consent in writing of the State Government, has entered into an arrangement, contract or understanding, with the owner of the coal mine under which the operations of the mine are substantially controlled by such person or body of persons: (g) "mine" means any excavation where any operation for the purpose of searching for or obtaining minerals has been or is being carried on. and includes- (i) all borings and bore holes: (ii) all shafts, whether in the course of being sunk or not: (iii) all levels and inclined planes in the course of being driven: (iv) all open cast workings: (v) all conveyors or aerial ropeways provided for the bringing into or removal from a mine of minerals of other articles or lor the removal of refuse therefrom: (vi) all lands, buildings, works, adits, levels, planes, machinery and equipments, instruments, stores, vehicles, railways, tramways and sidings in, or adjacent to, a mine and used for the purposes.....

THE ORISSA CATTLE & POULTRY FEED (REGULATION) ACT, 1979 THE ORISSA CATTLE AND POULTRY FEED (REGULATION) ACT, 1979 [Act No. 10 of 1979] [Came into force with effect from the 31st November 1979 (vide Forest and Animal Husbandry Department Notification No. 12998, dated 21-7-1981).] [03rd April 1979] PREAMBLE An Act to Provide for the Regulation of Production and Quality of Cattle and Poultry Feed in the State of Orissa BE it enacted by the Legislature of the State of Orissa in the Thirtieth Year of the Republic of India, as follows:- Section 1 - Short title, extent and commencement (1) This Act may be called the Orissa Cattle and Poultry Feed (Regulation) Act, 1979. (2) It extends to the whole of the State of Orissa (3) It shall come into force on such date as the State Government may, by notification, appoint in that behalf. Section 2 - Definitions In this Act, unless the context otherwise requires,- (a) "Form" means a form specified in Schedule II; (b) "licensee" means a person to whom a license has been granted for manufacturing or processing pre-mixed cattle feed or pre-mixed poultry feed; (c) "licensing authority" means the person appointed by the State Government.....

Bihar Reorganisation Act, 2000 Complete Act

.....pass to the State in which the principal seat of business of the undertaking is located. (4) Where any body corporate constituted under a Central Act, State Act or Provincial Act for the existing State of Bihar or any pan thereof has, by virtue of the provisions of Part II, becomes an inter-State body corporate, the investments in, or loans or advances to, any such body corporate by the existing State of Bihar made before the appointed day shall, save as otherwise expressly provided by or under this Act, be divided between the States of Bihar and Jharkhand in the same proportion in which the assets of the body corporate are divided under the provisions of this part. SECTION 47: ASSETS AND LIABILITIES OF STATE UNDERTAKINGS (1) The assets and liabilities relating to any commercial or industrial undertaking of the existing State of Bihar shall pass to the State in which the undertaking is located. (2) Where a depreciation reserve fund is maintained by the existing State of Bihar for any such commercial or industrial undertaking, the securities held in respect of investments made from that fund shall pass to the State in which the undertaking is located. In this Act, unless the context otherwise requires:- (1) "Agricultural Produce" means all produce and commodities, whether processed or unprocessed, of agriculture, horticulture, apiculture, sericulture, livestock and products of livestock, fleeces (raw wool) and skins of animals, forest produce etc. as are specified in the schedule or declared by the Government by notification from time to time and also includes a mixture.....
