The Minimum Wages Act, 1948 Complete Act

.....repugnant in the subject or context, 3 [(a) "adult", "adolescent" and "child" have the meanings, respectively, assigned to them in section 2 of the Factories Act, 1948 (63 of 1948); (b) "appropriate Government" means (i) in relation to any scheduled employment carried on by or under the authority of the 4 [Central Government or a railway administration] or in relation to a mine, oil field or major port, or any corporation established by 5 [a Central Act, the Central Government; and (ii) in relation to any other scheduled employment the 6 [State Government; (c) "competent authority" means the authority appointed by the appropriate Government by notification in its Official Gazette to ascertain from time to time the cost of living index number applicable to the employees employed in the scheduled employments specified in such notification; (d) "cost of living index number" in relation to employees in any scheduled employment in respect of which minimum rates of wages have been fixed, means the index number ascertained and declared by the competent authority by notification in Official Gazette to be the cost of living index number applicable to employees in such employment; (e).....

.....the purposes of this section, "ordinary rate of wages" in relation to a motor transport worker means his basic wages plus dearness allowance. [Cf: Factories Act, 1948, S. 59: Mines Act, 1952, S. 33.] Section 27 - Annual leave with wages (1) Without prejudice to such holidays as may be prescribed, every motor transport worker who has worked for a period of two hundred and forty days or more in a motor transport undertaking during a calendar year shall be allowed during the subsequent calendar year leave with wages for a number of days calculated at the rate of-- (a) if an adult, one day for every twenty days of work performed by him during the previous calendar year; and (b) if an adolescent, one day for every fifteen days of work performed by him during the previous calendar year. (2) A motor transport worker whose service commences otherwise than on the first day of January shall be entitled to leave with wages at the rate laid down in clause (a) or, as the case may be, clause (b) of sub-section (1), if he has worked for two-thirds of the total number of days in the remainder of the calendar year. Title: Extra Wages for Overtime

(1) Where an adult motor transport worker works for more than eight hours in any day in any case referred to in the first proviso to section 13 or where he is required to work on any day of rest under sub-section (2) of section 19, he shall be entitled to wages at the rate of twice his ordinary rate of wages in respect of the overtime work or the work done on the day of rest, as the case may be. (2) Where an adult motor transport worker works for more than eight hours in any day in any case referred to in the second proviso to section 13, he shall be entitled to wages in respect of the overtime work at such rates as may be prescribed. (3) Where an adolescent motor transport worker is required to work on any day of rest under sub-section (2) of Section 19, he shall be entitled to wages at the rate of twice his ordinary rate of wages in respect of the work done on the day of rest. (4) For the purposes of this section, "ordinary rate of wages" in relation to a motor transport worker means his basic wages plus dearness allowance. Title: Extra Wages for Overtime

State: Central

.....articles, as the worker is for the time being entitled to, but does not include a bonus and wages for overtime work. ( 3 ) Where any workers in a factory are paid on a piecerate basis, the time rate shall be deemed to be equivalent to the daily average of their full-time earnings for the days on which they actually worked on the same or identical job during the month immediately preceding the calendar month during which the overtime work was done, and such time rates shall be deemed to be ordinary rates of wages of those workers: Provided that in the case of a worker who has not worked in the immediately preceding calendar month on the same or identical job, the time rate shall be deemed to be equivalent to the daily average of the earning of the worker for the days on which he actually worked in the week in which the overtime work was done. (1) Where any building worker is required to work on any day in excess of the number of hours constituting a normal working day, he shall be entitled to wages at the rate of twice his ordinary rate of wages. (3) The cash equivalent of the advantage accruing through the concessional sale to a worker of food grains and other articles shall be computed as often as may be prescribed on the basis of the maximum quantity of food grains and other articles admissible to a standard family. Explanation 1."standard family" means a family consisting of an employee, his or her spouse and two children below the age of fourteen years requiring in all three adult consumption units. Explanation 2."adult consumption unit" means the consumption unit of a male above the age of fourteen years; and the consumption unit of a female above the age of fourteen years and that of a child below the age of fourteen years shall be calculated at the rates of . 8 and . 6 respectively of one adult consumption unit. (4) The State Government may make rules prescribing,- (a) the manner in which the cash equivalent of the advantage accruing through the concessional sale to a worker of food grains and other articles shall be computed; (b) the registers that shall be maintained in an establishment for the purpose of securing compliance with the provisions of this section.

Title: Fixing of Minimum Rates of Wages

.....the Payment of Wages Act 1936 (4 of 1936), minimum wages shall be fixed in accordance therewith. STATE AMENDMENTS Gujarat--In section 3 of the Act-- to sub-section (1A), the following proviso shall be added, namely:-- "Provided that, where the State Government had for any reason not fixed the minimum rates of wages in respect of any scheduled employment within one year from the date on which it came to a finding as aforesaid in respect of such employment, nothing contained in this sub-section shall, after the commencement of the Minimum Wages (Gujarat Amend­ment) Act, 1961, prevent the State Government from fixing the minimum rates of wages in respect of such employment even after the expiry of the said period of one year."
