THE BOMBAY AGRICULTURAL DEBTORS RELIEF ACT, 1947 THE BOMBAY AGRICULTURAL DEBTORS RELIEF ACT, 1947 Bombay Act No.XXVIII of 1947, [27th May 1947] An Act to consolidate and amend the law for the Relief of Agricultural Debtors in the Province of Bombay. WHEREAS it is expedient to consolidate and amend the law for the relief of agricultural debtors in the Province of Bombay and for certain other purposes specified herein; It is hereby enacted as follows: CHAPTER I PRELIMINARY SECTION 01: SHORT TITLE AND EXTENT (l) This Act may be called the Bombay Agricultural Debtors Relief Act, 1947. (2) it extends to the whole of the '(State] of Bombay except the City of Bombay. SECTION 02: DEFINITIONS: -IN THIS ACT. UNLESS THERE IS ANYTHING REPUGNANT IN THE SUBJECT OR CONTEXT (l) "award" means an award made under subsection (4) of section 8 or section 9, 32 or 33 or as confirmed or modified by the Court in appeal; (2) ''Co-operative society" means a society registered under the Provisions of the Bombay Cooperative Societies Act, 1925; (3) "Court" means the court of the Civil Judge (Senior Division ), having ordinary jurisdiction in the area where the debtor ordinarily resides and if.....

SECTION 04: CONTRACTS FOR USUFRUCT OF PROPERTY IN LIEU OF INTEREST A mortgage or other contract for the loan of money, by which it is agreed that the use or usufruct of any property shall be allowed in lieu of interest, shall be binding upon the parties. SECTION 05: AMOUNT OF INTEREST TO BE DEPOSITED IN CERTAIN CASES OF CONDITIONAL SALES UNDER BENGAL REGULATIONS Whenever, under the Regulations of the Bengal Code, a deposit may be made of the principal sum and interest due upon any mortgage or conditional sale of land hereafter to be entered into, the amount of interest to be deposited shall be at the rate stipulated in the contract, or, if no rate has been stipulated and interest be payable under the terms of the contract, at the rate of twelve per centum per annum. .....both movable and immovable (including claims due to him) which are not liable to attachment either under the Code of Civil Procedure, 1908 (Act V of 1908), as amended by section 31 of this Act or under any other law for the time being in force, a specification of the values thereof and of the places where the same may be found; (iii) a schedule of all his properties, both movable and immovable (including claims due to him) which are not included in the schedule under item (ii) of this clause; and (iv) a schedule of all his properties in respect of which a claim has been submitted to the registering officer under the Displaced Persons (Claims) Act, 1950 (XLIV of 1950), and, where any order has been passed in relation to the verification and valuation of the claim under that Act, with a certified copy of the order.
