The Punjab Security of Land Tenures Act, 1953 Complete Act

It is hereby enacted as follows: " Short title. 1. This Act may be called the Punjab Tobacco Vend Fees (Repealing) Act, 1953. Repeal of Punjab Act 5 of 1934. 2. The Punjab Tobacco Vend Fees Act, 1934 (Act 5 of 1934) is hereby repealed. Repeal of President's Act No. 6 of 1952. 3. The Punjab Tobacco Vend Fees (Repealing) Act, 1952 (President's Act 6 of 1952) is hereby repealed, but notwithstanding such repeal, anything done or any action taken in the exercise of any power conferred by or under the repealed Act shall be deemed to have been done or taken in exercise of the powers conferred by or under this Act, so far as consistent with the provisions of this Act, as if this Act had been in force on that date and all the provisions of this Act shall apply accordingly. .....title. 1. This Act may be called the Punjab Agricultural Produce Markets (Validation) Act, 1953. Validation of certain orders, proceedings and acts. 2. All orders made, proceedings taken and done in pursuance of Punjab Government notification No. 1362-E-52/2369, dated the 17th April, 1952, after the 16th October, 1952, in the exercise of the powers purporting to be derived by virtue of the aforesaid notification shall be deemed to be and always to have been validly made, taken and done as if the said notification had been approved by the Punjab Legislative Assembly to be continued in force as from 16th October, 1952, the date on which it would otherwise have ceased to operate, till the new committees are validly constituted. Bar of legal proceedings. 3. No suit or other legal proceeding whatever shall lie in any court against the State Government or any officer specified in the notification aforesaid for or on account of or in respect of any such order made, proceeding taken or act done as aforesaid and validated by the provisions of. the preceding section. 1. Section 2 - Amendment of Section 2(j) of Punjab Act III of 1949 In clause (j) of Section 2 of the East Punjab Urban Rent Restriction Act, 1949 (Act III of 19490, after the word "declared" the words "by the State Government" shall be inserted and shall be deemed always to have been so inserted as if this Act had been in force on and from the date of any notification issued in this behalf; and where in any proceedings concluded before the commencement of this Act any notification has been found to be invalid on the ground that the State Government was not empowered to issue such a notification, such finding shall be void and of no effect, and the Court shall, notwithstanding anything to the contrary contained in any other law for the time being in force, on application made within six months from the commencement of this Act by any party prejudicially affected by such finding, restore the proceedings at and continue it from the stage reached immediately before the order embodying or based on such finding was made. The competent authority shall at the same time submit to the Central government a report setting forth the full facts of the case with all connected papers and apply for the appointment of an arbitrator. Where the compensation is recurring, the competent authority shall, in cases covered by this sub-rule, deposit the amount in court from time to time in arrear as it falls due. (5) (I) Every person interested to whom an offer is made under sub-rule(3) shall, within fifteen days of the receipt of the offer, communicate in writing to the competent authority his acceptance, or otherwise of the offer. If he accepts the offer, the competent authority shall enter into an agreement with him on behalf of Central Government in Form ˜K'. (ii) In the following circumstances, the competent authority may, at his discretion, make [to all eligible claimants] ˜on account' payment upto 80 percent. Of the amount which, in his opinion, is likely to be assessed as compensation or recurring compensation as the case may be:- (a) When there is likely to be delay in assessing compensation; (b) Where the competent authority has made an assessment.....
