Maharastra Legislature Members Salaries and Allowances Act, 1956 Complete Act

VIII of 1952) (in this section referred to as "the said Act") and any law corresponding to the provisions of this Act in force immediately before the 1st day of November, 1956 in or in relation to any territories which after that date form part of the new 45State of Bombay shall stand repealed: Provided that notwithstanding such repeal any rules or orders made under the said Act shall, so far as they are not inconsistent with the provisions of this Act, continue in force and be deemed to have been made under the provisions of this Act, unless and until they are superseded by any rules or orders made under this Act. SECTION 02: SHORT TITLE There shall be established a Contingency Fund in the nature of an imprest entitled the3Contingency Fund of the State of Maharashtra] into which shall be paid from and out of the Consolidated Fund of the4[State of Maharashtra]5[a sum of eighty crores of rupees]. SECTION 03: CUSTODY OF THE CONTINGENCY FUND AND WITHDRAWALS THEREFROM The Contingency Fund of the State shall be held on behalf of the Governor by the Secretary to the6[Government of Maharashtra] in the Finance Department, and no advances shall be made out of such Fund except for the purposes of meeting unforeseen expenditure pending authorisation of such expenditure by the State Legislature under appropriations made by law. SECTION 04: POWER TO MAKE RULES For the purposes of carrying out the objects of this Act, the State Government may make rules regulating all matters connected with or ancillary to the custody of, the payment of moneys into, and withdrawals from, the Contingency Fund of the State. .....OF CERTAIN DISQUALIFICATIONS A person shall not be disqualified for being chosen as, or for being a member of the5[Maharashtra Legislative Assembly] or the6[Maharashtra Legislative Council] merely by reason of the fact that he holds any of the offices specified in Schedule I appended hereto. SECTION 03: TEMPORARY PROVISIONS For the removal of doubt, it is hereby declared that a person deemed to have been elected or chosen as a member of the Bombay Legislature under Section 28 or Section 34 of the States Reorganization Act, 1956 shall not be deemed to be disqualified for being elected or chosen as, or for being, a member of the said Legislature merely by reason of the fact that he holds an office declared, by any of the Acts specified in Schedule II or any other law in force immediately before the 1st day of November, 1956, to be an office of profit which shall not disqualify the holder for being elected or chosen as, or for being, a member of a State Legislature.
