THE CHHATTISGARH ANADHIKRIT VIKAS KA NIYAMITIKARAN (SANSHODHAN) ADHINIYAM, 2002 THE CHHATTISGARH ANADHIKRIT VIKAS KA NIYAMITIKARAN (SANSHODHAN) ADHINIYAM, 2002 PREAMBLE [Act No. 32 of 2002] An Act to amend the Chhattisgarh Anadhikrit Vikas Ka Niyamitikaran Adhiniyam, 2002 (No. 21 of 2002). Be it enacted by the Chhattisgarh Legislature in the Fifty-third year of the Republic of India as follows:-- Section 1 - Short Title and Commencement (i) This Act may be called the "Chhattisgarh Anadhikrit Vikas Ka Niyamitikaran (Sanshodhan) Adhiniyam, 2002 (No. 32 of 2002)." (ii) It shall come into force on such date as the State Government may, by notification in the official Gazette, appoint. Section 2 - Amendment in Section 6 After (iv) of Sub-section (1) of Section 6 of Chhattisgarh Anadhikrit Vikas Ka Niyamitikaran Adhiniyam, 2002 (No. 21 of 2002) the following provision shall be inserted namely,- "Provided that the amount of penalty to be imposed shall not be more than 50% of such evaluation and the cost of development of such infrastructure." (ii) It shall come into force on the date of its publication in the Chhattisgarh Gazette. Section 2 - Amendment of Section 49 In Sub-section (7-AA) of Section 49 of the Chhattisgarh Co-operative Societies Act, 1960 (No. 17 of 1961) for the words "twelve months", the words "twenty four months" shall be substituted. (2) In sub-section (1) and (2) of Section 239, after the words "unoccupied land" wherever it occurs the words "and Bhata land and Bade Jhad/Chhote Jhad Ka Jungle" shall be added. Section 4 - Insertion after sub-section (5) in section 239 After sub-section (5) of Section 239 of the principal Act, the following sub-section shall be.....
List Judgments citing this section.....and proof, of the misbehaviour or incapacity of the Pramukh Lokayukt and Lokayukt under sub-section (1) shall be as provided in the Judges (Inquiry) Act, 1968 (Act No. 51 of 1968), in relation to the removal of a Judge and accordingly, the provisions of this Adhiniyam shall, subject to necessary modifications apply in relation to the removal of Pramukh Lokayukt and Lokayukt as they apply in relation to the removal of a Judge. Section 6 - Matters that may be enquired into by Lok Aayog Subject to the provisions of this Adhiniyam, upon receiving specific information of misconduct or a complaint against the Chief Minister, a Minister or any other public servant, the Lok Aayog may proceed to inquire into the matter contained therein. Section 7 - Matters not subject to inquiry (1) Except hereinafter provided, Lok Aayog shall not conduct any inquiry under this Adhiniyam in the case of complaint in respect of any action if such action relates to any matter specified in the Third Schedule. (2) Lok Aayog shall not inquire into any action,- (a) in respect of which a formal and public inquiry has been ordered under the Public Servants (Inquiries) Act, 1950 (Act No. 37 of 1950);.....

(2) It shall come into force from the date of its publication in the official Gazette of Chhattisgarh. Section 2 - Insertion after sub-section (b) of Section 8 After sub-section (b) of Section 8 of the Chhattisgarh Madhyamik Shiksha Adhiniyam, 1965 (No. 23 of 1965) the following sub-section shall be inserted, namely :-- "(bb) To conduct such entrance examinations for professional courses which may be entrusted by the State Government." Section 13 - Powers of Government to make rules The Government may make rules for the purposes of effectively carrying out the provisions of this Act. Such rules may provide for all or any of the following matters, namely :- (i) procedure to be followed in regularisation of unauthorized development; (ii) norms for imposition of regularisation penalty; (iii) procedure for collection and utilisation of penalty for regularisation; (iv) procedure for exercise of powers conferred to the Authority under Section 6 of this Act. Section 14 - Savings Notwithstanding any thing contained in Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No. 23 of 1973), Chhattisgarh Municipal Corporation Act, 1956 (No. 23 of 1956), Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961) or Chhattisgarh Panchayat Raj Adhiniyam, 1993 (No. 1 of 1993) any local government, as the case may be, in relation to the unauthorized development under the provisions of this Act, from the date of commencement of this Act,.....
