Brief Appreciation of the evidence adduced:
Briefly the charge was that on .............. Mr ........................... (Accused) has beaten Mr................ the Inspection Supervisor. The accused was Charged under Orders No................ of the approved Industries Standing Orders.
Cross-Examination of Mr............... by Mr................................ Councel- I
He has asked Mr.............. whether he was in charge of packing and painting Section, for that Mr. ................................ answered that he was in charge of painting and Final Packing Inspection. As there was no objection to this answer, it is evident that Mr................ known that Mr................ responsibilities. When Mr...............asked Mr ...................whether he known that it is a misconduct and violation of company's approved standing orders to fight with workers, he answered that he knows that it is wrong to fight.
Cross-examination of Mr. ................ by Mr. ................
From in the cross-examination, Mr ...................answered that he himself directly deals with people without going through his supervisor. When asked why did he assume that Mr........................ has lifted his hand to hit him. Mr................................ answered that there was a past dispute regarding the working area. This shows that the situation was boiling and flared up on that day.
Cross-examination of Mr................... Painter By Mr..................................
From the cross-examination, we find that Mr.................................... Painter was not sure whether there was a quarrel or fight and he didn't notice which hand Mr. ................has lifted.
In the Cross-Examination of Mr. .................... by Mr. ............... has told that upon hearing whether he would like to stay or not in the company Mr..................has pushed Mr..................
From the above proceedings the following points emerge:
01. There was a past dispute in the working area and Mr. ..............used to object the packing people occupying the painting area. And the incident of Mr. ................. keeping cylinder in packing area has flared up the situation.
02. Mr. ................................. knows that Mr ............................. is in charge of painting and Final Inspection of Packing and as such he should have behaved more politely. Without referring the matter to his supervisor he has resorted to pushing and pulling the boxes from Mr..................
03. Both the eye witnesses concur that Mr................ has pushed Mr.............. but Mr................. painter was not fighting and Mr..............has lifted his hand saying whether Mr.............. would like to stay or not.
As both witnesses gave the same wordings as uttered by Mr..................upon hearing the words Mr................ has pushed Mr................ as seen by Mr................
In my opinion from the above statements, it is proved that................... has indeed misbehaved and an attempt for man handling was made as such he should be punished appropriately as per the approved standing orders of the company.
