Reduction in rank

Reduction in rank, a civil servant is reduced in rank only after an inquiry is held; he is informed of the charges against him in such inquiry and he is given a reasonable opportunity of being heard in respect of those charges. [Constitution of India, Art. 311(2)]Reduction in rank, if a civil servant has a right to a particular rank, then the very reduction from that rank will operate as a penalty, for he will then lose the emoluments and privileges of that rank. If, however, he has no right to the particular rank, his reduction from an officiating higher rank to his substantive lower rank will not ordinarily be a punishment (AIR 1958 SC 36 referred); Shitla Sahai Srivastava v. North Eastern Railways, AIR 1966 SC 1197 (1199): (1966) 3 SCR 61.The reduction in rank contemplated by the Article 311 of Constitution of India, 1950 is reduction as a punishment and where no punishment is involved the Article had no application. Any variation in the order of seniority to the prejudice of an off...

Rank

Rank, refers to a position, especially an official one, within a social organization, of high social order or other standing status, S.C. Advocate-on-Record Asn. v. Union of India, AIR 1994 SC 268.The word 'rank' has both a narrower as well as a wider meaning; in its ordinary sense as meaning grade or status, N.C. Dalwadi v. State of Gujarat,AIR 1987 SC 1933 (1937): (1987) 3 SCC 611: (1987) 3 SCR 640. [Bombay Civil Service Rules, 1959, R. 161(1)(c)(ii)(1)](ii) The expression 'rank', in 'reduction in rank' has, for purpose of Article 311 (2) an obvious reference to the stratification of the posts or grades or categories in the official hierarchy. It does not refer to the mere seniority of the government servant in the same class or grade or category, Nyadar Singh v. Union of India, AIR 1988 SC 1979: (1988) 4 SCC 170: (1988) Supp 2 SCR 546.The expression 'rank' in Art. 311(2) has reference to a person's classification and not his particular place in the same cadre in the hierarchy of the...

Rank - Precedence

Rank - Precedence, the word 'rank' in common parlance, as also in English election refers to a position, especially an official one, within a social organisa-tion, of high social order or other standing status. Likewise the word 'precedence' denotes the ceremonial order or priority to be observed on formal occasions, or a right to preferential treatment. In the same strain the word 'primacy' denotes the state of being first in rank or being in formal state i.e., the most important state. Thus it would be seen that not only is the word 'primacy' inextricably linked up with the words 'rank' and 'precedence' but conceptually they all are of the same family and breed, block and substance, Supreme Court Advocates on Record Association v. Union of India, (1993) 4 SCC 441: AIR 1994 SC 268 (445)....

Dismissal or removal or reduction in rank

Dismissal or removal or reduction in rank, Any and every termination of service is not a dismissal, removal or reduction in rank. A termination of service brought about by the exercise of a contractual right is not per se dismissal or removal. If the termination of service is founded on the right flowing from contract or the service rules then, prima facie, the termination is not a punishment and carries with it no evil consequences and so Art. 311 is not attracted. A reduction in rank likewise may be by way of punishment or it may be an innocuous thing, Parshotam lal Dhingra v. Union of India, AIR 1958 SC 36: (1958) SCR 828...
