Fertilisers of the soil. The purity of artificial manures under the statutory title (without a statutory definition) of 'fertilisers of the soil' is protected by the (English) Fertilisers and Feeding Stuffs Act, 1906 (6 Edw. 7, c. 27), repealing and re-enacting an Act of 1893. The Act requires sellers to give invoices, enables purchasers to have the fertiliser analysed by official analysts, and penalizes sellers for giving no invoices or false invoices. The (English) Fertilisers and Feeding Stuffs Act,1926 (16 & 17 Geo. 5, c. 45), now replaces the 1906 Act, See Needham v. Worcestershire County Council, (1909) 100 LT 901, and Aggs on Agricultural Holdings....


Purchase value

Purchase value, means the value of the specified goods as ascertained from the original invoice and includes insurance, excise, duties, counter-vailing duties, sales tax, transport fee, octroi, freight charges and all other charges incidentally levied on the purchase of the specified goods and in the case of the specified goods mentioned at serial number 1 of the schedule also the value of accessories fitted therein:Provided that where purchase value of the specified goods is not ascertainable on account of non-availability or non-production of the original invoice, or when the invoice produced is proved to be false, or if the specified goods are acquired or obtained otherwise they by way of purchase, than the purchase value shall be the value or price at which the specified goods of the like kind or quality are sold or are capable of being sold, in open market in the local area. Payable

Payable, 'payable' generally means that which should be paid, New Delhi Municipal Committee v. Kalu Ram, AIR 1976 SC 1637 (1639): (1976) 3 SCC 407: (1976) Supp SCR 87.The expression 'the full amount payable by the foreign buyer in respect of the goods' occurring in cl. (b) would mean merely the total amount which is due from the foreign buyer in respect of the goods actually exported; and what would be due from a foreign buyer has to be merely the price which he has been agreed to pay and not any fanciful, unreal or inflated price which the exporter may choose to falsely incorporate in the invoice with any ulterior motives. The foreign buyer cannot, by any stretch of imagination, be held to be liable to pay any amount over and above the price which he has promised to pay for the goods received by him and any difference between that price and the price given in the invoice can therefore not have the attribute of having become 'payable' by him, Director, Enforcement Directorate, Ministry...
