Hindu
Hindu, The historical and etymological genesis of the word 'Hindu' has given rise to a controversy amongst ideologists; but the view generally accepted by scholars appears to be that the word 'Hindu' is derived from the river Sindhu otherwise known as Indus which flows from the Punjab. 'That part of the great Aryan race', says Monier Williams, 'which immigrated from Central Asia, through the mountain passes into India, settled first in the districts near the river Sindhu (now called the Indus). The Persians pronounced this word Hindu and named their Aryan brethren Hindus. The Greeks, who probably gained their first ideas of India from the Persians, dropped the hard aspirate, and called the Hindus 'Indoi'. ('Hindulsm' by Monler Williams, p.1.)'. The Encyclopedia of Religion and Ethics, Vol. VI, has described 'Hinduism' as the title applied to that form of religion which prevails among the vast majority of the present population of the Indian Empire (p. 686). As Dr. Radhakrishnan has obs...
Hypothetical tenant
Hypothetical tenant, a term used in valuations for rating denoting the ideal or imaginary person who would take premises at an average of the rents likely to be paid by all persons who could be regarded as possible tenants, including the owner. 'In my opinion, the rent that the (hypothetical) tenant might reasonably be expected to pay is the rent which, apart from all conditions affecting or limiting its receipt in the hands of the land-lord, would be regarded as a reasonable rent for the tenant who occupied under the conditions which the statue imposes,' per Lord Buckmaster, Poplar Union Assessment Committee v. Roberts, 1922 AC 93....

Natural justice
Natural justice, the aim of the rules of natural justice is to secure justice or to put it negatively to prevent miscarriage of justice. These rules can operate only in areas not covered by any law validly made. In other words they supplant the rules of natural justice which are not embodied rules. What particular rule of natural justice should apply to a given case must depend to a great extent on the facts and circumstances of that case, the frame-work of the law under which the enquiry is held and the constitution of the Tribunal pointed for the purpose, A.K. Kraipak v. Union of India, AIR 1970 SC 150: (1969) 2 SCC 262.Historically, 'natural justice' has been used in a way 'which implies the existence of moral principles of self-evidence and unarguable truth'. In course of time, judges nurtured in the traditions of British jurisprudence, often involved it in conjunction with a reference to 'equity and good conscience'. Legal experts of earlier generations did not draw any distinctio...
On the occasion of
On the occasion of, is not equivalent to 'on the same date as'. An 'occasion is not a period of 24 hours.' If we say that a man took out an insurance policy on the occasion of his marriage we do not mean 'on the day of his marriage' but rather 'at or about the time of his marriage' with the implication that the coincidence in time was designed and not accidental, Ideal Life Assurance Co. Ltd. v. Hirschfield etc., (1943) 1 KB 442....

Religious education
Religious education, should consist of 'understand-ing the child as he is without imposing upon him an ideal of what we think he should be'. How-soever highly educated one may be but without deep integration of thought and feeling, one's life is incomplete, contradictory and torn with many fears; and as long as education does not cultivate an integrated outlook on life, it has very little significant, Aruna Roy v. Union of India, (2002) 7 SCC 368 (400). (Constitution of India, Art. 26)...

Shebaitship
Shebaitship, property dedicated to an idol vests in it in an ideal sense only; ex necessitas, the possession and management has to be entrusted to some human agent. Such an agent of the idol is known as shebait in Northern India. The legal character of a shebait cannot be defined with precision and exactitude. Broadly described, he is the human ministrant and custodian of the idol, its earthly spokesman, its authorised representative entitled to deal with all its temporal affairs and to manage its property. As regards the administration of the debutter, his position is analogous to that of a trustee; yet, he is not precisely in the position of a trustee in the English sense, because under Hindu Law, property absolutely dedicated to an idol, vests in the idol, and not in the shebait. Although the debutter never vests in the shebait, yet, peculiarly enough, almost in every case, the shebait has a right to a part of the usufruct, the mode of enjoyment; and the amount of the usufruct depen...
