Cadre

Cadre, In service jurisprudence, the term 'cadre' has a definite legal connotation. In the legal sense, the word 'cadre' is not synonymous with 'service'. Fundamental Rule 9(4) defines the word 'cadre' to mean the strength of a service or part of a service sanctioned as a separate unit, Chakradhar Paswan v. Local cadre, 'Local cadre' means any local cadre of posts under the State Government organised in pursuance of paragraph 3, or constituted otherwise, for any part of the State. S. Service and cadre

Service and cadre, according to the scheme of the Rules, 'Service' is a narrower body than the 'Cadre'. By the definition contained in r. 2(d), membership of the Service is limited to persons who are appointed in a substantive capacity to the Service. By the second part of r. 2(b), if read in an extended sense every temporary post which carries the same designation as that of any of the posts specified in the Schedule is a Cadre Post, whether such post is comprised in the Service or not. Cadre post

Cadre post, 'Cadre post' in the Fundamental Rules means a post as specified in the Schedule and includes a temporary post. The words 'in the cadre to which they belong' in Rule 6(3) cover the cases of permanent as well as temporary Additional District and Sessions Judges at the time of initial recruitment, G.R. Luthra v. Deputation

Deputation, concept of 'deputation' is well under-stood in service law and has a recognised meaning. 'Deputation' has a different connotation in-service law and the dictionary meaning of the word 'deputation' is of no help. In simple words 'deputation' means service outside the cadre or outside the parent department. Deputation is deputing or transferring an employee to a post outside his cadre, that is to say, to another department on a temporary basis. After the expiry period of deputation the employee has to come back to his parent department to occupy the same position unless in the meanwhile he has earned promotion in his parent department as per Recruitment Rules, State of Punjab v. Local area

Local area, 'Local area', in relation to any local cadre, means the local area specified in para 6 for direct recruitment to posts in such local cadre, and includes, in respect of posts belonging to the category of Civil Assistant Surgeons, the local area specified in sub-para (5) of paragraph 8 of this Order', S.
