..... the dominant purpose of the act is to see that all agricultural commodities and livestock or products of livestock are sold or purchased through regulated markets, the market committees being empowered to issue licences to traders in a notified area. ..... while holding so, the supreme court observed: 'production, supply and distribution of goods was no doubt within the exclusive sphere of the state legislature but it was subject to the provisions of entry 33 of list 3 which gave concurrent powers of legislation to the union as well as the states in the matters of trade and commerce in, and the production supply and distribution of, the products of industries where the control of such industries by the union was declared by parliament by law to be expedient in the public interest. ..... when, however, it came to the products of the controlled industries comprised in entry 52 of list i, trade and commerce in, and production, supply and distribution of these goods became the subject-matter of entry 33 of list iii and both parliament and the state legislatures had jurisdiction to legislate in regard thereto. ..... if the matters had stood there, thesugar industry being a controlled industry legislation in regard to the same would have been in the exclusive province of parliament and production, supply and distribution of the product of sugar industry viz. .....

..... these writ petitions have been filed by the petitioners and the writ appeals have been filed by the apmc and the petitioners who are rice millers having licences under the provisions of the rice milling industries (regulation) act, 1958, questioning the validity of the marketing committee constituted under the provisions of the karnataka agricultural produce marketing (regulation) act, 1966 (in short 'marketing act') levying the market fee on the rice.2. ..... under sub-section (1) of section 12 of the act, a market committee is empowered to levy market fee on any notified agricultural produce, livestock or products of livestock purchased or sold in the notified market area. ..... the karnataka rice procurement levy order, 1984 and the scope of the control order make it obligatory to the rice millers to sell the rice at a price fixed by the government and there is no provision under the said order for levying or collecting market fee or any fee for the sale of rice under that order. ..... 'the act was enacted primarily for the regulation of sale and purchase of agricultural produce and for the establishment, superintendence and control of markets therefor ..... the contention is quite against the provisions of the act and the concession shown by the learned counsel which is against the statute is not valid as held by the supreme court in tripura goods transport association and another v commissioner of taxes and others ..... so, there is no repugnancy or inconsistency between the control order and the act. .....

..... farming operation : term includes farming, tillage of the soil, dairy farming, ranching, production or raising of crops, poultry, or livestock, and production of poultry or livestock products in an unmanufactured state. ..... we also find that there is another old central enactment, agricultural produce (grading and marking) act, which in section 2(a) defined agricultural produce as under : " 'agricultural produce' includes all produce of agriculture or horticulture and all articles of food or drink wholly or partly manufactured from any such produce and fleeces and the skins of animals ;" again, the schedule to the said act lists 'eggs' as the third item immediately after 'fruits' and 'vegetables' and prior to such items like 'dairy produce', 'coffee', etc. ..... no doubt, it could be argued that the definition of 'agricultural produce' to include eggs in the agricultural produce (grading and marking) act or the specific inclusion of poultry as part of agriculture under the agricultural refinance (and development) corporation act, pertain to the purposes of those acts and does not and cannot extend the meaning of 'agricultural produce' in section 80p(2)(a)(iii) of the 1961 act. .....
