Reported in : 2010(1)ALT499

ORDERVilas V. Afzulpurkar, J.1. WP. No. 23391 of 2009 is filed by the State - respondents 1 to 4 in O.A. No. 10431 of 2008 and is directed against the interim order of suspension of G.O.Ms. No. 158 School Education (SER.V) Department dated 02.12.2008 ordered by the Andhra Pradesh Administrative Tribunal. The other batch of cases is also related to the same or similar issue arising under different OA's.2. For the sake of convenience, the facts in WP. No. 23391 of 2009 are being referred to for consideration of this entire batch of cases. It is already noticed that this writ petition is directed against an interim order and in normal course we would not have entertained the writ petition but for the circumstances that the Andhra Pradesh Administrative Tribunal is unable to take up and decide the OA as well as the vacate petitions moved therein by the State on account of circumstances beyond it's control. Para 30 of the affidavit filed by the State in support of this writ petition gives t...

A. Srinath Reddy Vs. Union of India (Uoi) Rep. by Cabinet Secretary

Court : Andhra Pradesh

Reported in : 2009(3)ALT676

ORDERVilas V. Afzulpurkar, J.1. The petitioner, who is a resident of Nalgonda District and is also said to be a Member of the Law Society of England and Wales, and working as a Solicitor at London, United Kingdom, seeks to challenge 5th and 7th amendments to the Constitution of India, whereunder, the proviso to Article 3 of the Constitution of India was amended. Petitioner also seeks restoration of proviso to Article 3, as it existed prior to 5th amendment i.e. before 24-12-1955. The petitioner further seeks that the word 'ascertain' in the said proviso be read and interpreted as 'taking consent' of the State Legislature.2. We have heard the petitioner who appeared as party-in-person and made his submissions elaborately. We have also heard the learned Assistant Solicitor General, appearing for the Union of India, who has opposed the present writ petition on various grounds.3. Article 3 of the Constitution of India reads as follows:3. Formation of new States and alteration of areas, bou...

M. Rama Krishna S/O Late M. Seshagiri Rao and anr. Vs. the Government ...

Court : Andhra Pradesh

Reported in : 2009(2)ALT330

V.V.S. Rao, J.1. An interesting question falls for consideration in these two writ petitions. The question is regarding right of District Judge Grade I (DJ), who is appointed as Upa-Lokayukta under Andhra Pradesh Lokayukta and Upa-Lokayukta Act 1983 (Lokayukta Act, for brevity), to claim Dearness Allowance or Dearness Relief (DA/DR) on the pension payable to Upa-Lokayukta after remitting office after completion of term of five years. Petitioners in these two cases, who held office of Upa-Lokayukta contend that a District Judge who is appointed as Upa- Lokayukta is entitled to claim DR on pension drawn as DJ as well as Upa- Lokayukta. The Government admits entitlement of petitioners of DA on pension payable as District Judges but oppose payment of DA on pension payable as Upa-Lokayukta. Whether they are entitled to two pensions and two DAs or two pensions and one DA is contentious issue in these matters and hence this common order. 2. The fact of the matter is not in dispute. Petitioner...
