The petitioner has challenged in this writ petition the award of the Labour Court dated 3-4-1998 where, on a preliminary point the Labour Court held that the petitioner is not a workman under Section 2(s) of the Industrial Disputes Act, 1947 and consequently passed an award dated 19-6-1998 rejecting his application filed under Section 10(4-A) of the Industrial Disputes Act in which he has challenged the order of termination,2. Petitioner's husband being an employee of the State Government, was under an obligation to take out a policy of insurance on his life during his tenure of employment and this is governed by the Karnataka Government Servants (Compulsory Life Insurance) Rules, 1958 ('the Rules' for short). Under Rule 6 of these Rules, insurance is compulsory for Government servants and a premium amount of 6 1/4 % of the average salary of the employee is required to be remitted to the Government for issuing a life assurance policy under these Rules. Under the Rules, there is an option given to an employee to have a life assurance policy over and above this amount also and on payment of higher premium.2. This appeal is by the plaintiff, Life Insurance Corporation of India, hereinafter referred to as 'the Corporation', arising out of Long Cause Suit No. 233 of 1961 on the file of the Second Additional Munsiff, Hubli. The Corporation filed a suit for recovery of Rs. 6,046.65 alleging that the said sum is due from defendants Nos. 1 to 3 after adjusting the amounts paid by them. Defendants Nos. 1 to 3 executed a simple mortgage deed on October 30, 1953, in four of the then United Karnataka Insurance Co. Ltd., Dharwar, for a sum of Rs. 8,000. It was agreed that the amount will carry interest at 6% per annum and the loan was repayable by monthly installments of Rs. 150 towards the principal and interest commencing from December 1, 1953 ; in default of payment of any six installments, the principal due on that date along with interest becomes payable. Each of these petitions under article 226 of the Constitution raises the same question regarding the constitutional validity of section 6B(1) of the Karnataka Sales Tax Act, 1957 ('Act' for short) as amended by Karnataka Act No. 13 of 1982, which provides for the levy of non-half per cent. of 'turnover tax' on every dealer whose total turnover in a year exceeds rupees one lakh. 2.
