The instant writ petition is directed against the judgment cum award dated 21.9.1994 passed by the Labour Court, Bikaner in Case No. 40/1990 whereby the reference made by the State Government under Section 10(1)(G) of the Industrial Disputes Act, 1947 was disposed of directing that the dismissal of the respondent workman Mahendra Yadav from service of petitioner school shall be effective from 21.9.1994. Succinctly stated the facts are that the respondent no. 2 workman was engaged as watchman in the petitioner school in the year 1977. It appears that there were complaints regarding the performance of the duties and conduct of the employee on which he was dismissed from service w.e.f. 20.3.1986 after holding a domestic enquiry wherein it was found that the workman was guilty of misconduct. The respondent workman raised an industrial dispute. The State Government referred the dispute to the Labour Court, Bikaner under Section 10(1)(G) of the I.D.Act. By this petition, they have prayed for a direction to declare the Notification dated 18.9.2009 issued by the State Government as illegal and to quash the same with consequential directions, by which the Notification dated 6.10.2008 issued by the State Government under the authority of the Governor of Rajasthan declaring the Gram Panchayat Napasar as Municipality (Nagar Palika) Class IV, was withdrawn in exercise of the powers under section 3(1)(a) of the Rajasthan Municipalities Ordinance, 2008, which was later-on enacted as the Rajasthan Municipalities Act, 2009. This writ petition has been filed by the petitioner aggrieved against the order dated 7.9.2015 passed by the Director and Joint Secretary, Directorate, Local Self Department, Rajasthan, Jaipur, whereby the petitioner has been placed under suspension. The petitioner, who was initially appointed as Assistant Revenue Inspector on 22.12.1983 was last promoted in 1994 on the post of Revenue Inspector and at the time when the order impugned placing the petitioner under suspension was passed, he was discharging his duties on the post of Executive Officer, Municipal Board, Itawa.
