ORDER1. This petition is directed against the order dated 26-5-1976 passed by the Principal, 1st Munsiff, Bangalore, allowing I. A. No. III filed under Order 26, Rule 9 r/w Section 151, C. P. C. by the defendant in O. S. No. 1782 of 1972 on his file. The prayer made in I. A. No. III and the impugned order read :--Prayer made in I. A. No. 5741 of 1975 rejecting the appellant's writ petition at the preliminary hearing stage. 2. The appellant is the landlord owning 3 acres of agricultural land in Koodlur village, Somwarpet Taluk, in Survey Nos. 19/1 and 19/2. The second respondent alleging that he is the tenant of the said land filed an application under Section 48A of the Karnataka Land Reforms Act for grant of occupancy right. The said application was opposed by the appellant on the ground that the second-respondent is not a tenant of the said land and the appellant is personally cultivating the land. C. Honniah, J.1. These two appeals arise from the judgment of the Sessions Judge, Coorg, Mercara, dated 10th of March 1977, by which he convicted A-1 to A-4 under Section 366 of the I.P.C. A-1 and A-4 have filed these two appeals; A-2 and A-3 have not filed any appeal and they are undergoing the sentence.2. The facts are these:On 16-12-1974 Ponnamma (P. W. 1) aged about 20 years a resident of Boikeri village near Mercara, met A-1 (Ponnamma) at the bus stand in Mercara. While they were talking A-1 came to know that P. W. 1 was in search of a job. This writ petition preferred by three land-holders is directed against the order of the Land Tribunal, Kadur, dated 24-7-1975 conferring occupancy right in respect of four lands on respondent No. 3 under S. 48-A of the Karnataka Land Reforms Act, 1961.2.
