Ughal & Ruby Pandey, Advocates For the State : A.P.P. -------- 5/ 07.08.2013 Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution. The petitioner has been made accused for the offences under Sections 467, 468, 477(A), 409, 420 / 34 of the Indian Penal Code, in connection with Jagarnathpur P.S. Case No. 50 of 2012 corresponding to G.R. No. 1000 of 2012. From the FIR, it appears that in two cheques, which were issued for the amount of Rs. 50,000/- each, the amounts were made Rs. 5,50,000/- and the money was withdrawn from the account of Patel Khadi Gramoudhog Sewa Sanstha. The petitioner is also one of the signatories of the said cheques. It also appears from the FIR itself that out of those two cheques, the amount of one cheque was deposited in the account of the co-accused and amount of other cheque was deposited in the account of wife of co-accused. Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and has drawn the attention of this Court towards the order dated 21.1.2013 passed in B.A. No. 9046 of 2012, whereby co-accused Pradeep Patel was granted bail on the undertaking that he shall refund the entire amount of Rs. 11.00 lakhs. The wife of the said co-accused was also granted anticipatory bail by this Court and the said order has also been brought on record. In the facts of this case, I am inclined to enlarge the petitioner, Ranjit Kumar, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of Sri S. N. Tiwary, learned Judicial Magistrate, Ranchi, or his successor, in connection with Jagarnathpur P.S. Case No. 50 of 2012 corresponding to G.R. No. 1000 of 2012. ( H. C. Mishra, J.) R.Kr.
